      72-8155c.   U.S.D. 410 authorized to transfer certain land. The board of education of unified school district No. 410, Marion county, is hereby authorized to transfer a tract of land described as part of the northeast quarter (NE 1/4) of section 17, township 18 south, range 2 east, Marion county, Kansas, and further described as beginning 140 feet east of the intersection of the north line of eighth street and the east line of Lawrence avenue in the city of Durham; thence east 160.25 feet; to the west line of Abilene avenue; thence north 175 feet; thence east 226.3 feet to the east line of the northeast 1/4; thence north 782.5 feet to a point 851.9 feet south of the northeast corner of the northeast 1/4; thence west 560.55 feet; thence south 392 feet; thence east 28 feet; thence south 340.5 feet; thence east 140 feet; thence south 225 feet to the point of beginning, together with the one-story brick schoolhouse, the one-story shop building, and the multipurpose building thereon, to the city of Durham, Kansas. Such transfer may be made by the board of education in consideration of $5 and release from the amount of the financial obligation of the school district, including interest, owed to the city of Durham for wastewater and sewer bonds of the city, and upon such terms and conditions as may be mutually agreed upon by both parties. The provisions of K.S.A. 72-8212 shall not apply to the transaction authorized by this act. The transfer herein shall be made by warranty deed if in the opinion of the attorney of the city of Durham such a deed is appropriate, and if in the city attorney's opinion a warranty deed is not appropriate, such transfer shall be made by quitclaim deed.
