72-8155a. U.S.D. 463 authorized to transfer certain land; protest petition and election. The board of education of unified school district No. 463, Cowley county, is hereby authorized to transfer a tract of land, described as lots 1, 2, 3, 4, 5 and 6, block 21, town of Rock, Cowley county, Kansas, together with the building thereon, to Rock township of Cowley county for a township community center and school purposes in consideration of one dollar and no other consideration. The provisions of K.S.A. 72-8212 shall not apply to the transaction authorized by this act. The transfer herein authorized shall be made by warranty deed if in the opinion of the attorney of said board of education such a deed is appropriate, and if in his opinion a warranty deed is not appropriate, such transfer shall be made by quitclaim deed. No transfer shall be made under this section until a resolution authorizing such transfer is passed by such board of education and published once a week for three (3) consecutive weeks in a newspaper having general circulation in the school district, and such resolution shall specify the transfer proposed under authority thereof. After the adoption of such resolution such transfer may be made unless a petition in opposition to the same, signed by not less than ten percent (10%) of the qualified electors of such school district, is filed with the clerk of the school district within ninety (90) days following the last publication of the resolution. In the event such a petition is filed, such transfer shall not be made unless the board of education submits the question to the voters at an election called for such purpose or at the next general election in which case the transfer may be made if a majority of those voting at such election on the proposition vote in favor thereof.
