2006 Kansas Code - 60-3339

      60-3339.   Compliance with act shall be considered by tribunal in determining penalties. If a person or entity has implemented an environmental management system, consistent with the primary characteristics prescribed by subsection (d)(2) of K.S.A. 60-3334, a court or administrative tribunal which finds a violation of such laws, or extension of such laws, shall give consideration to that fact in determining whether to impose administrative, civil or criminal penalties and in determining the severity of any penalties imposed.
