2006 Kansas Code - 38-1546

      38-1546.   Hearings; opportunity to review records or reports by guardian ad litem, effect of noncompliance. (a) Except as otherwise provided in this subsection, not less than 48 hours, excluding Saturdays, Sundays and legal holidays, before a hearing pursuant to this code, the child's guardian ad litem shall, upon request, be provided an opportunity to review any records or reports in the custody of the department which are necessary to the conduct of such hearing. The 48-hour time period provided for in this subsection shall not apply to protective custody hearings pursuant to this code.

      (b)   Failure to comply with the provisions of subsection (a) shall be grounds for a continuance of the hearing until such records or reports have been provided to the guardian ad litem for the period required by subsection (a).

      (c)   This section shall be part of and supplemental to the Kansas code for care of children.
