25-4612. Optical scanning equipment fraud; penalty. Optical scanning equipment fraud is:
(a) Being in unlawful or unauthorized possession of ballots or programs; or
(b) intentionally tampering with, altering, disarranging, defacing, impairing or destroying any optical scanning equipment or component part thereof, or any ballot, used by a system.
Optical scanning equipment fraud is a severity level 10, nonperson felony.
