68B.23 - HONORARIA -- BANNED.

        68B.23  HONORARIA -- BANNED.
         1.  Except as provided in subsection 2, a public official or
      public employee shall not seek or accept an honorarium from a
      restricted donor.
         2.  A public official or public employee may accept an honorarium
      from any person under the following circumstances:
         a.  The honorarium consists of payment of actual expenses of a
      donee for registration, food, beverages, travel, and lodging paid in
      return for participation in a panel or speaking engagement at a
      meeting when the expenses relate directly to the day or days on which
      the recipient has participation or presentation responsibilities.
         b.  The honorarium consists of a nonmonetary item or series of
      nonmonetary items that the public official or public employee donates
      within thirty days to a public body, a bona fide educational or
      charitable organization, or the department of administrative services
      as provided in section 68B.22, subsection 3.
         c.  The honorarium consists of a payment made to a public
      official or public employee for services rendered as part of a bona
      fide private business, trade, or profession in which the public
      official or public employee is engaged if the payment is commensurate
      with the actual services rendered and is not being made because of
      the person's status as a public official or public employee, but,
      rather, because of some special expertise or other qualification.
