523A.804 - MEDIATION.

        523A.804  MEDIATION.
         1.  The commissioner may order a seller to participate in
      mediation in any dispute regarding a purchase agreement.  Mediation
      performed under this section shall be conducted by a mediator
      appointed by the commissioner and shall comply with the provisions of
      chapter 679C.
         2.  Mediation of these disputes shall include attendance at a
      mediation session with the mediator and the parties to the dispute,
      listening to the mediator's explanation of the mediation process,
      presentation of one party's view of the dispute, and listening to the
      response of the other party.  Participation in mediation does not
      require that the parties reach a mediation agreement.
         3.  Parties to the mediation shall have the right to advice and
      presence of counsel at all times.  The parties to the mediation shall
      present any mediation agreement reached through the mediation to the
      commissioner.  If a mediation agreement is not reached, the mediator
      shall file a report with the commissioner.  The costs of the
      mediation shall be approved by the commissioner and shall be borne by
      the insurance division's regulatory fund.
