(a) The prohibitions of Article 11, Section 12 of the Constitution of the State of Indiana do not apply to: (1) the public employees' retirement fund (IC 5-10.3); (2) the Indiana state teachers' retirement fund (IC 5-10.4); (3) the Indiana state police pre-1987 benefit system (IC 10-12-3); (4) the Indiana state police 1987 benefit system (IC 10-12-4); or (5) any other public pension or employee retirement fund administered by the board of trustees of the Indiana public retirement system. (b) Investments of the funds listed in subsection (a) are subject to the following limitations and regulations: (1) Investments of the public employees' retirement fund and any other public pension or employee retirement fund administered by the board of trustees of the Indiana public retirement system are subject to IC 5-10.3-5-3, including P.L.37-1996, and IC 5-10.5-5. (2) Investments of the Indiana state teachers' retirement fund are subject to IC 5-10.4-3-10 and IC 5-10.5-5. (3) Investments of the Indiana state police benefit system are subject to IC 10-12-2-2.
