Chapter 8.1. Enforcement by the Commission

Civil action filed by commission
Sec. 1. The commission may file a civil action for appropriate
relief if the commission has reasonable cause to believe that:
(1) a person is engaged in a pattern or practice of resistance to
the full enjoyment of any right granted by this article; or
(2) a person has been denied any right granted by this article and
that denial raises an issue of general public importance.
An action under this section may be filed in a circuit or superior court
located in the county in which the alleged pattern, practice, or denial
occurred.

Relief by court
Sec. 2. In an action filed under section 1 of this chapter, the court
may do the following:
(1) Award preventive relief, including a permanent or temporary
injunction, restraining order, or other order against the person
responsible for a violation of this article as necessary to assure
the full enjoyment of the rights granted by this article.
(2) Award other appropriate relief, including monetary damages,
reasonable attorney's fees, and court costs.
(3) To vindicate the public interest, assess a civil penalty against
the respondent in an amount that does not exceed the following:
(A) Fifty thousand dollars ($50,000) for a first violation.
(B) One hundred thousand dollars ($100,000) for a second or
subsequent violation.

Intervention by aggrieved person or party to conciliation
agreement
Sec. 3. A person may intervene in an action filed under section 1
of this chapter if the person is:
(1) an aggrieved person to the discriminatory housing practice;
or
(2) a party to a conciliation agreement concerning the
discriminatory housing practice.

Enforcement of subpoena by attorney general
Sec. 4. The attorney general, on behalf of the commission or other
party at whose request a subpoena is issued under this chapter, may
enforce the subpoena in appropriate proceedings in the court in which

the action is filed.
