Chapter 1. Establishment of Bureau of Motor Vehicles
Commission
IC 9-15-1-1
Creation; character
Sec. 1. The bureau of motor vehicles commission is established.
The commission is a body corporate and politic, and though separate
from the state, the exercise by the commission of the commission's
powers constitutes an essential governmental function. The
commission may sue and be sued and plead and be impleaded.

Membership of commission board
Sec. 2. (a) The commission board consists of the following five
(5) individuals:
(1) Four (4) individuals, not more than two (2) of whom may be
members of the same political party, who:
(A) shall be appointed by the governor;
(B) serve for terms of four (4) years;
(C) may not hold any other public office or serve as a state
or local employee while serving as a commission board
member; and
(D) shall devote as much time as is needed to carry out their
duties, but are not required to devote full time to their duties.
(2) The commissioner, who:
(A) shall serve as chairman of the commission board; and
(B) is responsible for calling commission board meetings.
(b) The commission consists of all:
(1) officers and employees of the license branches under
IC 9-16; and
(2) other officers and employees designated as commission
employees.

Quorum of commission board
Sec. 3. Three (3) commission board members constitute a quorum.
The consent of three (3) commission board members is required
before any action may be taken.

Per diem salaries; expenses
Sec. 4. (a) Each member of the commission board who is not a
state employee is entitled to the minimum salary per diem provided
by IC 4-10-11-2.1(b). A board member is also entitled to
reimbursement for traveling expenses and other expenses actually
incurred in connection with the member's duties, as provided in the
state travel policies and procedures established by the Indiana
department of administration and approved by the budget agency.
(b) Each member of the commission board who is a state
employee is entitled to reimbursement for traveling expenses and
other expenses actually incurred in connection with the member's
duties, as provided in the state travel policies and procedures
established by the Indiana department of administration and
approved by the budget agency.
