Download as PDF IC 5-29-3 Chapter 3. Tourism Information and Promotion Fund IC 5-29-3-1 "Fund" Sec. 1. As used in this chapter, "fund" refers to the tourism information and promotion fund established by section 4 of this chapter. As added by P.L.229-2005, SEC.4. IC 5-29-3-2 "Promotion" Sec. 2. As used in this chapter, "promotion" includes the planning and conducting of information and advertising campaigns. As added by P.L.229-2005, SEC.4. IC 5-29-3-3 "Tourism group" Sec. 3. As used in this chapter, "tourism group" means a private nonprofit corporation established under Indiana law whose purposes include the promotion of tourist resources and facilities in Indiana. As added by P.L.229-2005, SEC.4. IC 5-29-3-4 Fund established Sec. 4. (a) The tourism information and promotion fund is established within the state treasury. The fund shall be used for the purposes of this chapter. (b) The fund consists of appropriations from the general assembly and gifts, donations, bequests, devises, and contributions received by the office. (c) The office shall administer the fund. The following may be paid from money in the fund: (1) Grants. (2) Expenses of administering the fund. (3) Nonrecurring administrative expenses incurred to carry out the purposes of this chapter. (d) The money in the fund at the end of a state fiscal year does not revert to the state general fund but remains in the fund. (e) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public funds may be invested. Interest that accrues from these investments shall be deposited in the state general fund. As added by P.L.229-2005, SEC.4. IC 5-29-3-4.3 References to tourism information and promotion fund Sec. 4.3. A reference in any law or other document to the tourism information and promotion fund established by IC 4-4-3.5-2 (before its repeal by P.L.229-2005) shall be treated after June 30, 2005, as a reference to the tourism information and promotion fund established by section 4 of this chapter. As added by P.L.220-2011, SEC.113. IC 5-29-3-5 Grants Sec. 5. The office may make grants from the fund to tourism groups for the promotion of tourist resources and facilities in Indiana. However, each grant must be matched by funds provided by the applicant, and the office may not provide more than one-half (1/2) of the funds for a project. The matching funds required from the applicant may be provided by any source except other state funds. As added by P.L.229-2005, SEC.4. IC 5-29-3-6 Grant guidelines Sec. 6. (a) The office shall establish guidelines for the application and approval of grants. (b) The office may seek the recommendations from the council when making a determination to approve or reject a grant application. As added by P.L.229-2005, SEC.4. IC 5-29-3-7 Promotional material Sec. 7. Promotional materials produced with the assistance of funds provided under this chapter must include the following statement: "Produced in cooperation with the Indiana Office of Tourism Development." Promotional materials must also include a statement provided by the office. As added by P.L.229-2005, SEC.4. IC 5-29-3-8 Rules Sec. 8. The office may adopt rules under IC 4-22-2 to carry out this chapter. As added by P.L.229-2005, SEC.4.
