Chapter 9. Governmental Entities: Immunity for Certain Activities on Property Leased by a State Agency

Application of prior law
Sec. 0.2. (a) The addition of IC 34-4-16.9 (before its repeal, now codified in this chapter) by P.L.7-1993 is intended to be a restatement of IC 4-16-3 (before its repeal).
(b) It is intended that the substantive operation and effect of IC 4-16-3 continue uninterrupted.
(c) P.L.7-1993 does not affect any:
(1) rights or liabilities accrued;
(2) penalties incurred;
(3) violations committed; or
(4) proceedings begun;
before July 1, 1993. Those rights, liabilities, penalties, offenses, and proceedings continue and shall be imposed and enforced under IC 4-16-3 (before its repeal) as if P.L.7-1993 had not been enacted.

Assurances of safety unauthorized
Sec. 1. A person who goes on or through property leased to an agency for any purpose is not entitled to any assurance that the property is safe for the purpose.

Immunity of owner for property user's acts or omissions
Sec. 2. The owner of the property does not:
(1) assume responsibility for; or
(2) incur liability for;
any injury to person or property caused by an act or failure to act of persons using the property.

Duty of care or ground of liability for injuries not created by chapter
Sec. 3. This chapter does not create a duty of care or ground of liability for injury to person or property.
