Definitions
35-43-10-1 Sec. 1. The definitions in IC 25-26-14 apply
throughout this chapter.

Application of chapter
35-43-10-2 Sec. 2. Except as provided by federal law or
regulation, this chapter does not apply to a pharmaceutical
manufacturer that is approved by the federal Food and Drug
Administration.

IC 35-43-10-3
Legend drug deception; penalty
35-43-10-3 Sec. 3. A person who knowingly or intentionally:
(1) possesses a contraband legend drug;
(2) sells, delivers, or possesses with intent to sell or deliver a
contraband legend drug;
(3) forges, counterfeits, or falsely creates a label for a legend
drug or falsely represents a factual matter contained on a label
of a legend drug; or
(4) manufactures, purchases, sells, delivers, brings into Indiana,
or possesses a contraband legend drug;
commits legend drug deception, a Class D felony.

IC 35-43-10-4
Legend drug deception resulting in death; penalty
35-43-10-4 Sec. 4. A person:
(1) who knowingly or intentionally manufactures, purchases,
sells, delivers, brings into Indiana, or possesses a contraband
legend drug; and
(2) whose act under subdivision (1) results in the death of an
individual;
commits legend drug deception resulting in death, a Class A felony.
