ARTICLE V
(405 ILCS 80/5‑1) (from Ch. 91 1/2, par. 1805‑1)
Sec. 5‑1.
As the mental health and developmental disabilities or
mental retardation authority for the State of Illinois, the Department
of Human Services shall
have the authority to license, certify and prescribe standards
governing the programs and services provided under this Act, as well as all
other agencies or programs which provide home‑based or community‑based
services to the mentally disabled, except those services, programs or
agencies established under or otherwise subject to the Child Care Act of
1969 or the Nursing Home Care Act, as now or hereafter amended, and this
Act shall not be construed to limit the application of those Acts.

Sec. 5‑2.
The Department shall have all powers and duties necessary
to implement this Act.

Sec. 5‑3.
The Department shall adopt rules pursuant to the Illinois
Administrative Procedure Act to implement this Act.
The rules shall include the intake procedures, application process and
eligibility requirements for those who apply for services under the Act.
The Department will convene a family advisory council and seek advice from
the council on ways to appropriately implement Articles II and III of the Act.
