Section 54-502 - PRACTICE DEFINED.

54-502. Practice defined. Any one (1) or any combination of the following practices, when done upon the upper part of the human body for cosmetic purposes and not for the treatment of disease or physical or mental ailments and when done for payment either directly or indirectly or without payment for the public generally, constitutes the practice of barbering or barber-styling:
(1) Barber-styling:
(a) Shaving or trimming the beard or cutting, trimming, arranging, dressing, curling, waving by any method, straightening, cleansing, singeing, bleaching, coloring, or similar work upon the hair;
(b) Fitting, cutting or dressing hairpieces or toupees;
(c) Giving facial and scalp massage or treatments with oils, creams, lotions or other preparations, either by hand or mechanical appliances;
(d) Applying cosmetic preparations, antiseptics, powders, oils, clays or lotions to scalp, face, neck or upper part of the body.
(2) Barbering:
(a) Shaving or trimming the beard or cutting, trimming, arranging, dressing, curling, cleansing, singeing, or similar work upon the hair;
(b) Fitting, cutting or dressing hairpieces or toupees;
(c) Giving facial and scalp massage or treatments with oils, creams, lotions or other preparations, either by hand or mechanical appliances;
(d) Applying cosmetic preparations, antiseptics, powders, oils, clays or lotions to scalp, face, neck or upper part of the body.
(3) Barber Instructing: Providing practical and theoretical instruction in any one (1) or any combination of the practices set forth in subsections (1) and (2) of this section. A barber instructor license issued by the board shall permit the holder to both practice and instruct only within the scope of the instructor’s board approved training and experience. The holder of a barber license issued by the board who is subsequently issued a barber instructor license shall be permitted to practice and instruct only within the definition of barbering.
