Section 46-1150 - OFFENSES SUBJECT TO COURT-MARTIAL -- RESOLUTION OF CONFLICT WITH CIVIL COURTS.

46-1150. Offenses subject to court-martial -- Resolution of conflict with civil courts. The jurisdiction of courts-martial shall be limited to violations of the punitive articles in this code. Any person subject to this code who is charged with the commission of an offense which is not included in a punitive article under this code shall be surrendered to civil authorities for process in accordance with civil law. Any person so surrendered shall be considered properly absent from his military duties unless said person is found guilty of a violation of civil law. If said person is convicted of a civil offense, he shall be considered absent without leave from the time of such surrender, unless he has requested and been granted authorized leave by his commander. Conflicts over jurisdiction over offenses shall be resolved in favor of civil jurisdiction.
