46-1105. Jurisdiction to try persons who fraudulently obtained discharge. Each person discharged from the Idaho military who is later charged with having fraudulently obtained his discharge is, subject to the applicable statute of limitations, subject to trial by court-martial on that charge and is, after apprehension or the service of charges required by section 46-1123, Idaho Code, whichever occurs first, subject to this code for that trial.
