                                SCRAP DEALERS
    54-2703.  PENALTIES FOR VIOLATIONS OF ACT. (1) Any scrap dealer who shall
be found guilty of, enter a plea of guilty for, or be convicted of an
intentional violation of any of the provisions of this act shall be guilty of
a misdemeanor upon the first violation within a five (5) year period, and
shall be fined not less than two hundred fifty dollars ($250) nor more than
one thousand dollars ($1,000) or imprisoned for a period not in excess of six
(6) months, or both, in the discretion of the court. Any scrap dealer who
shall be found guilty, enter a plea of guilty for, or be convicted of an
intentional violation of any of the provisions of this act for the second time
within five (5) years, notwithstanding the form of the judgment(s) or withheld
judgment(s), shall be guilty of a felony. Provided, that this act shall not be
construed to in anywise impair the power of counties, cities or incorporated
municipalities in this state to license, tax and regulate any scrap dealer.
    (2)  In addition to the criminal penalties provided in this section, every
person convicted of a violation of the provisions of this chapter shall pay
restitution in accordance with chapter 53, title 19, Idaho Code.
