2005 Idaho Code - 54-1743 — LICENSE REQUIREMENTS
TITLE 54 PROFESSIONS, VOCATIONS, AND BUSINESSES CHAPTER 17 PHARMACISTS 54-1743. LICENSE REQUIREMENTS. Each out-of-state mail service pharmacy shall be licensed by the board of pharmacy. In order to be licensed by the board to do business in the state of Idaho and for annual renewal of the license, every out-of-state mail service pharmacy shall: (1) Be licensed in good standing by the state in which its dispensing facilities are located and shall comply with all applicable laws, regulations, and standards of such state and the United States; (2) Submit an application in form and content as determined by the board but including the following minimum information: (a) Ownership; (b) Location; (c) Identity of a pharmacist licensed to practice pharmacy in the state of domicile, who shall be the pharmacist in charge of the out-of-state mail service pharmacy; and (d) Such further information as the board may deem necessary. (3) Pay a fee for the initial license in the amount of five hundred dollars ($500) and annual renewal in an amount not to exceed the amount set forth in section 54-1720, Idaho Code; (4) Submit evidence satisfactory to the board that its physical facilities, records and operations are in accordance with the laws and regulations of the state in which the facilities are located; (5) Submit certification satisfactory to the board that it will cooperate with all lawful requests and directions from the regulatory board or licensing authority of its state of domicile relating to the shipment, mailing or delivery of dispensed legend drugs to Idaho residents; (6) Submit to the board, at the beginning of each calendar quarter, the following information acceptable to the board in form and substance, by the pharmacist-in-charge, concerning each prescription for a scheduled controlled substance shipped, mailed or delivered to an Idaho resident: (a) Name of patient; (b) Name of practitioner; (c) Number of prescription; (d) Date of prescription; (e) Name of drug; and (f) Strength and quantity of dosage. (7) In lieu of providing the information required in subsection (6) of this section to the board, the out-of-state mail service pharmacy may submit to on-site inspection by the board. (8) Every out-of-state mail service pharmacy shall submit to the board a current list of all pharmacists employed by said pharmacy dispensing prescriptions for shipment to Idaho. Such list shall be updated by January 31 of each year and shall include the following information: (a) The full legal name of the pharmacist; (b) The location of the facility at which the pharmacist is employed and dispensing prescriptions for shipment to Idaho; (c) The identity of the state in which the pharmacist is licensed; (d) A certification by the out-of-state mail service pharmacy that the pharmacist is in good standing with the licensing authority of the state of licensing and that no disciplinary action is pending.
