                                  TITLE  54
                    PROFESSIONS, VOCATIONS, AND BUSINESSES
                                  CHAPTER 17
                                 PHARMACISTS
    54-1726.  GROUNDS FOR DISCIPLINE. The board of pharmacy may refuse to
issue or renew, or may suspend, revoke or restrict the licenses of any person,
pursuant to the procedures set forth in chapter 52, title 67, Idaho Code, upon
one or more of the following grounds:
    (a)  Unprofessional conduct as that term is defined by the rules of the
board;
    (b)  Incapacity of a nature that prevents a pharmacist from engaging in
the practice of pharmacy with reasonable skill, competence and safety to the
public;
    (c)  Being found guilty, convicted or having received a withheld judgment
or suspended sentence by a court of competent jurisdiction in this state or
any other state of one or more of the following:
    1.  Any felony;
    2.  Any act involving moral turpitude, gross immorality or which is
    related to the qualifications, functions or duties of a licensee; or
    3.  Violations of the pharmacy or drug laws of this state or rules
    pertaining thereto, or of statutes, rules or regulations of any other
    state, or of the federal government;
    (d)  Fraud or intentional misrepresentation by a licensee in securing the
issuance or renewal of a license.
    (e)  Engaging or aiding and abetting an individual to engage in the
practice of pharmacy  without a license, or falsely using the title of
pharmacist.
    (f)  Being found by the board to be in violation of any of the provisions
of this chapter, chapter 27, title 37, Idaho Code, or rules adopted pursuant
to either chapter.
