2005 Idaho Code - 50-215 — PROSECUTIONS AGAINST CORPORATIONS UNDER CITY ORDINANCE

                       GENERAL PROVISIONS -- GOVERNMENT
                                 -- TERRITORY
    50-215.  PROSECUTIONS AGAINST CORPORATIONS UNDER CITY ORDINANCE. In all
prosecutions of any corporation for a violation of any city ordinance or any
forfeiture or penalty provided by ordinance of such city, it shall be
sufficient to make the corporation in its corporate name a defendant and
service may be procured by serving of summons upon the president, secretary,
or other managing agent of such corporation; and after the return of such
service, the court shall be deemed to have acquired jurisdiction of the
defendant and may proceed to try said cause; and any judgment imposed by said
court shall have the force and effect of a judgment in a civil suit action and
execution may issue thereon, and the corporate property, rights and franchises
of said defendant may be sold thereunder in satisfaction of the same. The
summons herein authorized to be served upon a defendant corporation shall
contain a statement that the corporation shall appear forthwith and defend
said action, and in case of failure to so appear and defend, a plea of not
guilty will be entered by the court and the trial will proceed as if said
defendant shall have appeared. A copy of the complaint shall be attached to
and served with said summons.
