TITLE 49 MOTOR VEHICLES CHAPTER 4 MOTOR VEHICLE REGISTRATION 49-438. PENALTY FOR EXCEEDING REGISTERED GROSS WEIGHT OR PERMITTED MAXIMUM REGISTERED GROSS WEIGHT. (1) Any person who shall operate, cause, permit, or suffer to be operated upon any highway any vehicle or combination of vehicles with a gross weight in excess of the registered maximum gross weight of the vehicle specified in this title shall have committed a violation under the infraction or misdemeanor provisions of section 49-1013, Idaho Code. (2) Any person who shall operate, cause, permit, or suffer to be operated upon any highway any vehicle or combination of vehicles with a gross weight in excess of the registered maximum gross weight not authorized by a valid permit issued pursuant to section 49-432, Idaho Code, shall have committed a violation under the infraction or misdemeanor provisions of section 49-1013, Idaho Code.
