2005 Idaho Code - 43-341 — EFFECT ON WATER RIGHTS BY LEASING
TITLE 43 IRRIGATION DISTRICTS CHAPTER 3 POWERS AND DUTIES OF BOARD OF DIRECTORS 43-341. EFFECT ON WATER RIGHTS BY LEASING. Use of water under a lease authorized by this act shall not constitute abandonment, or be grounds for forfeiture, of the water right, and shall not be deemed a change in the place of use or in the nature of the use of the water. Any change in the point or points of diversion of water shall require approval of the director of the department of water resources as provided in section 42-222, Idaho Code, but the director shall not be required to determine whether a water right has been abandoned or forfeited, in whole or in part, before approving any change in the point of diversion.
