41-235. NOTICE OF HEARING. (1) Except where a longer period of notice is
provided by other provisions of this code relative to particular matters, not
less than fourteen (14) days in advance the director shall give notice of the
time and place of the hearing, stating the matters to be considered thereat.
If the persons to be given notice are not specified in the provision pursuant
to which hearing is held, the director shall give such notice to all persons
whose pecuniary interests are to be directly and immediately affected by such
hearing.
(2) If any such hearing would otherwise require separate notices to more
than one hundred (100) persons, in lieu of the notice required under such
subsection the director may give notice of the hearing by publishing the
notice in at least three (3), but not to exceed five (5), daily newspapers, at
least once each week during the four (4) weeks immediately preceding the week
in which the hearing is to be held. The director shall select such newspapers,
as to location and circulation, as he deems necessary to give adequate
opportunity of notice to such persons as should receive notice of the hearing.
The published notice shall state the time and place of the hearing and shall
specify the matters to be considered thereat. At the time of first publication
the director shall mail to every advisory organization which has filed with
him pursuant to section 41-1425, Idaho Code, a copy of the published notice if
the proposed hearing would affect any interest of the members of such advisory
organization.
(3) All such notices, other than published notices, shall be given as
provided in section 41-212, Idaho Code.
