                              PCB WASTE DISPOSAL
    39-6205.  RULES AND REGULATIONS IN GENERAL. Pursuant to the procedures
established by the Idaho administrative procedures act, chapter 52, title 67,
Idaho Code, the board shall adopt such rules and regulations as are necessary
and feasible to regulate the disposal of PCB wastes through land disposal or
incineration within the state. The board may not adopt any rule more stringent
or broader in scope than TSCA and the regulations adopted pursuant thereto
relating to the disposal of PCB wastes through land disposal or incineration,
and shall amend or repeal any conflicting rules existing on the effective date
of this chapter, including rules adopted by senate concurrent resolution no.
126 of the second regular session of the forty-eighth legislature in 1986;
provided, that the board may promulgate rules and regulations for incineration
of PCB wastes including those not regulated by TSCA pursuant to section
39-115, Idaho Code; and provided further, that the board may promulgate
procedural rules and regulations, and rules and regulations specifically
authorized by this chapter or other Idaho law. Any rule or regulation
promulgated by the board shall be valid until repealed or modified through the
administrative process of chapter 52, title 67, Idaho Code.
