                              PCB WASTE DISPOSAL
    39-6204.  LEGISLATIVE INTENT. The legislature intends that the state of
Idaho enact and carry out a PCB waste program to regulate the disposal of PCB
waste.
    The legislature finds that the TSCA and regulations adopted pursuant
thereto, establish complex and detailed provisions for regulation of those who
generate, transport, treat, store and dispose of PCB wastes. The legislature
cannot conveniently or advantageously set forth in this chapter all the
requirements of all of the regulations which have been or will be established
under TSCA. Though the legislature desires to avoid the existence of
duplicative, overlapping or conflicting state and federal regulatory systems,
the legislature finds that PCB waste disposal should be regulated by the state
through rules and regulations promulgated by the board in a manner consistent
with this chapter, TSCA, and regulations adopted pursuant thereto by the
administrator of the United States environmental protection agency.
