2005 Idaho Code - 39-1222 — ACTION AGAINST UNLICENSED FOSTER HOME, CHILDREN\'S AGENCY, CHILDREN\'S THERAPEUTIC OUTDOOR PROGRAM OR CHILDREN\'S RESIDENTIAL CARE FACILITY

                       CHILD CARE LICENSING REFORM ACT
    39-1222.  ACTION AGAINST UNLICENSED FOSTER HOME, CHILDREN'S AGENCY,
CHILDREN'S THERAPEUTIC OUTDOOR PROGRAM OR CHILDREN'S RESIDENTIAL CARE
FACILITY. Notwithstanding the existence or pursuit of any other remedy, the
department shall, upon showing good cause to the prosecuting attorney who
shall represent the department in the proceeding, maintain an action in the
name of the state for injunction or other process against a person as defined
herein who shall hereafter operate or maintain any foster home, children's
agency, children's therapeutic outdoor program or children's residential care
facility without first having secured a license pursuant to the provisions of
this chapter. Upon a finding that the safety of children at a foster home,
children's agency, children's therapeutic outdoor program or children's
residential care facility is endangered, the department has the authority to
immediately revoke a license.
