2005 Idaho Code - 22-3403 — EXPERIMENTAL PERMITS

                                  TITLE  22

                                  CHAPTER 34
                          PESTICIDES AND CHEMIGATION
    22-3403.  EXPERIMENTAL PERMITS. Provided that the state is authorized by
the Administrator of EPA to issue experimental permits and subject to the
terms and conditions of such authorization, the director may:
    (1)  Issue an experimental permit to any person applying for an
experimental permit if he determines that the applicant needs such permit in
order to accumulate information necessary to register a pesticide for a
special local need under section 22-3402(5), Idaho Code, and that the
pesticide use under the proposed terms and conditions would not cause
unreasonable adverse effects on the environment.
    (2)  Prescribe terms, conditions, and period of time for the experimental
permit.
    (3)  Revoke or modify any experimental permit, at any time, if he finds
that its terms or conditions are being violated, or that its terms and
conditions are inadequate to avoid unreasonable adverse effects on the
environment.
