21 GCA REAL PROPERTY CH. 81 GOVERNMENT OF GUAM ADA COMPLIANCE ACT OF 2023 CHAPTER 81 GOVERNMENT OF GUAM ADA COMPLIANCE ACT OF 2023 SOURCE: This entire Chapter added by P.L. 37-070:1 (Mar. 6, 2024) effective Oc. 1, 2026 pursuant to P.L. 37-070:2. § 81101. § 81102. § 81103. § 81104. § 81105. § 81106. § 81107. Short Title. Definitions. Accessibility Compliance Requirement. Accessibility Compliance Requirement; Compliance Plan. Accessibility Compliance Plan; Reporting. Enforcement. ADA Compliance. § 81101. Short Title. This Act shall be known as the “Government of Guam ADA Compliance Act of 2023.” § 81102. Definitions. As used in this Chapter: (a) ADA means the Americans with Disabilities Act of 1990, as amended. (b) Accessibility standards means the accessibility requirements and guidelines established by the ADA, including those outlined in the ADA Accessibility Guidelines (ADAAG) and the 2010 ADA Standards for Accessible Design. (c) Government leased office means any office space leased or rented by any government agency or department of the government of Guam. (d) Person with a disability means an individual who has a physical or mental impairment that substantially limits one (1) or more major life activities. § 81103. Accessibility Compliance Requirement. (a) All government leased offices on Guam, whether leased by federal, territorial, or local government agencies, shall comply with the accessibility standards outlined in the ADA, the ADAAG, and the 2010 ADA Standards for Accessible Design. (b) Government agencies and departments leasing office spaces are responsible for ensuring that the leased offices meet or exceed ADA accessibility standards. (c) Agencies and departments shall conduct accessibility assessments and make necessary modifications to leased office spaces to ensure compliance with ADA accessibility standards. § 81104. Accessibility Compliance Requirement; Compliance Plan. (a) Government agencies and departments leasing office spaces shall develop and implement an Accessibility Compliance Plan to address identified barriers and achieve compliance with ADA accessibility standards. (b) The Accessibility Compliance Plan shall include a timeline for completing necessary modifications and shall be submitted to the Guam Department of Integrated Services for Individuals with Disabilities for review and approval. 1 COL 20240430 21 GCA REAL PROPERTY CH. 81 GOVERNMENT OF GUAM ADA COMPLIANCE ACT OF 2023 (c) Government agencies and departments shall allocate necessary funds in their budgets to implement the Accessibility Compliance Plan. § 81105. Accessibility Compliance Plan; Reporting. (a) Government agencies and departments leasing office spaces shall annually transmit a written report on the progress of accessibility compliance to the Speaker of I Liheslaturan Guåhan and the Guam Department of Integrated Services for Individuals with Disabilities. (b) The Guam Department of Integrated Services for Individuals with Disabilities shall monitor compliance with this Chapter and may provide technical assistance to agencies and departments to achieve accessibility compliance. § 81106. Enforcement. The Guam Department of Integrated Services for Individuals with Disabilities shall have the authority to investigate complaints regarding non-compliance with this Chapter and recommend appropriate actions. § 81107. ADA Compliance. All request for proposals issued by the government of Guam, relative to government leased office spaces or construction of government buildings, shall comply with all rules and regulations of the ADA. ---------- 2 COL 20240430
