Severability. § 18101. The Dr. Antonio C. Yamashita Educator Corps: Creation. There is hereby created ‘The Dr. Antonio C. Yamashita Educator Corps (‘Educator Corps’) composed of the Guam Teacher Corps, the Guam Counselor Corps, the Fifth-Year Induction Corps, and the Guam Principal Corps. SOURCE: Added by P.L. 24-231:2 (Aug. 12, 1998) and amended by P.L. 27-096:2 (June 25, 2004). § 18102. Educator Corps Council Composition and the School of Education. The Educator Corps Council shall consist of seven (7) members. These members are: the administrative chair of the School of Education of the College of Professional Studies or its successor in interest of the University of Guam; the Personnel Administrator of the Department of Education or its successor in interest; the Associate Superintendent for Special Education of the Department of Education or its successor in interest; a school principal from the Department of Education or its successor in interest; a guidance counselor from the Department of Education or its successor in interest; a secondary school teacher who has been a master teacher for at least one (1) semester from the Department of Education or its successor in interest, or the Guam Community College; and an elementary school teacher who has been a master teacher for at least one (1) semester from the Department of Education or its successor in interest. The principal, guidance counselor and teachers shall be appointed by the Superintendent of Education. The members of the Council shall elect a chairperson from among themselves to preside over all meetings of the Council. The School of Education of the University of Guam shall provide logistics and personnel necessary for the operation of the Council, and the University of Guam shall serve as the custodian for the Program's funds and records. The Educator Corps Administrator shall be a faculty member of the School of Education and shall serve in a non-voting, ex-officio capacity as the Executive Secretary of the Council. Quorum and Vacancy in the Council. Any four (4) members of the Council shall constitute a quorum. A vacancy in the Council shall not affect its powers. SOURCE: Repealed by P.L. 25-024:2 (June 2, 1999). Reenacted in present form by P.L. 27-096:4 (June 25, 2004). § 18103. Duties and Responsibilities. The Dr. Antonio C. Yamashita Educator Corps Council shall advise the School of Education of the University of Guam regarding the professional education programs contained in this Chapter as they relate to the recruitment and education of prospective teachers, counselors and school administrators and continuing education requirements for the recertification of teachers. SOURCE: Amended by P.L. 27-096:5 (June 25, 2004). Amended by P.L. 28150:V:47 (Sept. 30, 2006) with the effective date of Oct. 1, 2006, pursuant to P.L. 28150:V:52. § 18103.1. School of Education: Duties and Responsibilities. The duties and responsibilities of the School of Education of the University of Guam shall include: (a) establishing, pursuant to the Administrative Adjudication Law, rules, regulations and appropriate policies to govern the Educator Corps; (b) periodically assessing the professional staffing needs of Guam's public schools and the Guam Community College; (c) establishing priorities for scholarship awards based on the needs of the Department of Education and the Guam Community College; (d) developing an annual program budget; (e) establishing rules by which deferments of completion of degree programs may be granted; (f) establishing rules by which deferments of repayment through employment service may be granted; (g) establishing criteria for the selection and award of Educator Corps Scholarship Awards; 3 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (h) reviewing and approving Educator Corps Scholarship Awards; (i) designating and compensating representatives within Guam's high schools, such as the advisors for the Future Educators of America, to promote the Teacher Corps Program among high school students; and (j) designating and compensating Mentors within the Department of Education participating in the Fifth-Year Teacher Induction Program in accordance with rules and regulations enacted pursuant to the Administrative Adjudication Law. SOURCE: Added by P.L. 28-150:V:48 (Sept. 30, 2006) with the effective date of Oct. 1, 2006, pursuant to P.L. 28-150:V:52. § 18103.2. Annual Program Assessment and Evaluation. Within a month of the end of each academic year, the President of the University of Guam shall conduct an annual assessment and evaluation of the programs created by this Chapter. The findings and recommendations of this evaluation shall be submitted in a report to I Liheslaturan Guåhan. SOURCE: Added by P.L. 28-150:V:49 (Sept. 30, 2006) with the effective date of Oct. 1, 2006, pursuant to P.L. 28-150:V:52. § 18104. Educator Corps Administrator: Duties and Responsibilities. The duties and responsibilities of the Educator Corps Administrator shall include: (a) serve as the chief officer of the Educator Corps; (b) administer the day-to-day operations of the Educator Corps; (c) screen applications and make recommendations to the School of Education for scholarship awards to Educator Corps candidates; (d) monitor the repayment of scholarships through appropriate employment service; (e) collect payments from scholarship recipients who have not met the employment service requirements herein; (f) review and make recommendations to the School of Education on requests for deferment of repayment through appropriate employment service of scholarship funds; and 4 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (g) perform any duties assigned by the School of Education or necessary for the effective and efficient operation of the Educator Corps. § 18105. Budget and Compensation. The budget for salaries, stipends, travel and operational requirements shall be submitted annually by the School of Education for approval by I Liheslaturan Guahan. I Liheslaturan Guahan shall appropriate funds to the University of Guam which shall disburse them pursuant to the directives and policies of the School of Education. Unexpended funds shall be maintained in a continuing budget appropriation for use by the School of Education only for purposes authorized in this Section in succeeding budget cycles. § 18106. Prior Appropriations to the Guam Teacher Corps. All funds appropriated to the Guam Teacher Corps prior to the enactment of this Article shall be deemed as appropriated to The Dr. Antonio C. Yamashita Educator Corps. § 18107. Garnishment of Income Tax Refunds in the Event of Default. The Dr. Antonio C. Yamashita School of Education may, subject to the terms and conditions of a Memorandum of Understanding with the Department of Revenue and Taxation, garnish the tax refunds due to any recipient of assistance pursuant to this Chapter and/or the recipient’s cosigner(s) who has defaulted on the repayment of such assistance and a judgment has issued. Such garnishment shall not exceed the judgment amount. SOURCE: Added by P.L. 27-051:2 (Dec. 17, 2003). § 18108. Severability. If any part or provision of this Chapter, or the application of this Chapter to any person or circumstance, is held invalid, the remainder of this Chapter, including the application of such part or provisions to other persons or circumstances, shall not be affected by such a holding and shall continue in full force and effect. To this end, the provisions of this Chapter are severable. Composition of Guam Teacher Corps. Guam Teacher Corps Scholarship and Financial Assistance Program. Teacher Corps Scholarships for Those With Prior Baccalaureate Degree. Teacher Corps Scholarships for Specialist Teachers. Teacher Corps Scholarships for Non-education Majors. Academic Advisor and Program Contract. Prioritization of Scholarships According to Teaching Needs. Prior Rules and Law Shall Apply to Applicants Currently in the Program or Under Repayment Status. § 18201. Composition of Guam Teacher Corps. (a) The Guam Teacher Corps shall consist of students who have declared their intention to become educators and who are enrolled in the teacher educational programs at the University of Guam, or if such programs are not available at the University of Guam, at other accredited institutions which have been approved by the School of Education and who have been duly accepted into the Guam Teacher Corps Scholarship Program. (b) Scholarship and financial assistance may be awarded to eligible students who meet the following criteria: (1) are bona fide residents of Guam; (2) are citizens or permanent resident aliens of the United States; (3) are seniors or graduates of an accredited high school with an overall grade point average of not less than 2.5 on a 4.0 scale; (4) have been admitted to the University of Guam in accordance to its admissions policies; (5) maintain an overall grade point average of 2.5 or better during the term of assistance under this program; (6) agree to practice education in a public school funded by the government of Guam in areas of need upon graduation and certification to practice on Guam. 6 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (A) If no vacant teaching positions exist in such public schools in his or her area(s) of certification, a Teacher Corps graduate may teach in a private school on Guam towards meeting their Teacher Corps scholarship repayment obligations. The Department of Education and the Guam Community College shall certify that no vacancies in the Teacher Corps graduate’s area(s) of certification exist prior to allowing private school employment. (B) The length of commitment of service to Guam shall be the total number of years that the student has received the scholarship and financial assistance. (C) Only teaching service in public schools funded by the government of Guam and/or Guam private schools licensed by the government of Guam shall be credited for repayment of the Teacher Corps scholarship. (D) (i) Those Teacher Corps graduates who were allowed to teach in licensed private schools on Guam shall accept employment with the Department of Education should a position in their area(s) of certification become available at the start of each semester until such time that their scholarship is repaid. The Department of Education and the Guam Community College shall provide each eligible graduate a notice of available position at least thirty (30) days prior to the required date of employment. (ii) The student further agrees that, in the event of refusal to fulfill this obligation, the student shall repay the government of Guam an amount equal to the balance of the total monthly allowances paid to the student which have not already been satisfied through service or payment, including tuition, stipends and the actual cost to the government of textbooks and supplies. (iii) Any deferment of repayment through services shall conform to rules adopted by the School of Education under the provisions of § 18103(f) of this Chapter; and (7) have been recommended to the program by: 7 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (A) an educator, including a teacher/instructor, counselor or school administrator who worked in an educational institution at the time the applicant was a student in such educational institution, and (B) by any other individual other than a relative who can attest to the character of the applicant. 2015 NOTE: Subsection designations were added to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. This section was originally added by P.L. 21-088:2 (Jan. 27, 1992), entitled “Teacher Training Council,” which was reenacted as 3 GCA § 9116 by P.L. 31-255:2 (Dec. 11, 2012). § 18202. Guam Teacher Corps Scholarship and Financial Assistance Program. (a) Students in the program must complete an application form provided by the School of Education and satisfy all the requirements set out in § 18101, supra. (b) A monthly allowance shall be paid to a person who is enrolled pursuant to the following schedule: (1) college freshman, Two Hundred Dollars ($200.00) per month; during the period the person is classified academically as a sophomore, Three Hundred Dollars ($300.00) per month; during the period the person is classified academically as a junior, Four Hundred Dollars ($400.00) per month; and senior and above standing, Five Hundred Dollars ($500.00) per month. The stipends for Teacher Corps scholarship recipients whose study concentrations are in special education, early childhood education, Chamorro language instruction, or secondary education or related major with concentration in science or mathematics shall be one hundred twenty-five percent (125%) of the amounts herein. (2) In cases where a student with prior course credit is accepted into the Teacher Corps Scholarship Program, such student's standing as freshman, sophomore, junior or senior in terms of credit hours shall not reflect the levels of stipend amounts specified within Item (b)(1) of this Section. The Stipend for students with prior credit shall be based on the number of years required to complete the Teacher Corps Scholarship Program on the following schedule: 8 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (A) Four (4) years to complete the program, the stipend starts at freshman level; (B) Three (3) years to complete the program, the stipend starts at sophomore level; two (2) years to complete the program, the stipend starts at junior level; and (C) One (1) year to complete the program, the stipend starts at senior level. (3) As a condition for continuing full entitlement to the benefits provided in this Chapter, with the exception of high school seniors, undergraduate recipients must (A) maintain a full-time enrollment of twelve (12) semester credits minimum per semester, (B) six (6) semester credits per summer session, and (C) good academic standing with a grade point average of 2.5 or better. No student may receive benefits beyond the number of calendar years normally required to complete such student's program. (4) Employees of DOE. Notwithstanding any other provision of law, administrative rules and regulations, School Aides, Library Technicians, Limited-Term Teachers with a bachelors degree or higher who are seeking teacher certification, and Chamorro Language Teachers whom do not have a bachelors degree, that are employed by the Department of Education, may qualify for financial assistance through the Guam Teacher Corps and may: (A) continue such employment while enrolled in the Guam Teacher Corps; and (B) enroll in the Guam Teacher Corps on a part-time basis. Those opting for part-time enrollment must be enrolled in at least six (6) credit hours per semester and are entitled to a stipend equal to fifty percent (50%) of the stipends provided for in Item (b)(1) of this Section. School Aides enrolled on a full-time basis while maintaining employment in such capacity with the Department of Education are entitled to the full stipend amount as provided them by Item (b)(1) of this Section. Other employees within the Department of Education may 9 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS qualify for assistance as provided by this Section; provided, that such employees’ actual job duties primarily deal with the instruction or supervision of students. A letter of recommendation from the applicant's supervisor attesting to the applicant's job duties shall be required. (c) Registration, tuition and other related fees normally assessed by the University and an allowance not to exceed the amount of Two Hundred Fifty Dollars ($250.00) shall be allowed per regular semester, and One Hundred Dollars ($100.00) per summer session in which a person is enrolled to cover costs of textbooks and supplies. Teacher Corps Scholarships for Those With Prior Baccalaureate Degree. (a) The Educator Corps Council may award Teacher Corps scholarships to individuals possessing a baccalaureate degree in a course of study other than education for the purpose of meeting teacher certification requirements. (b) The scholarships awarded under this Section shall be based on the recruitment needs of the Department of Education/Guam Community College and shall be limited to a period of time not to exceed two (2) years. (c) The stipend for such applicants shall be the same as a junior and senior under the provisions of § 18202(b) of this Article for the first and second years of study respectively. 2015 NOTE: Subsection designations were added to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. § 18202.2. Teacher Corps Scholarships for Specialist Teachers. (a) The Educator Corps Council may award Teacher Corps scholarships beyond the four (4) year limitation of § 18202 for individuals to seek graduate training, that may include a masters degree, for teaching specialties that require training beyond a baccalaureate degree. 10 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (1) This Section shall apply only to specialist areas that require graduate training as a minimum requirement for certification and shall not be used for as a means for existing teachers to meet promotional requirements. (2) The scholarships awarded under this Section shall be based on the recruitment needs of the Department of Education/Guam Community College and shall be limited to a period of time not to exceed two (2) years. (3) The stipend for such applicants shall be the same as a senior under the provisions of § 18202(b) of this Article for each additional year of study. (b) The Educator Corps Council may, based on the needs of the Department of Education or the Guam Community College for specialist teachers, authorize part-time scholarships if the prospective scholarship recipient is a teacher with the Department of Education or the Guam Community College. If such part-time scholarships are authorized, the terms and conditions shall be the same as scholarships awarded under the Counselor Corps Program in Article 3 of this Chapter. 2015 NOTE: Subsection designations were added to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. § 18202.3. Teacher Corps Scholarships for Non-education Majors. The Educator Corps Council may award Teacher Corps Scholarships to individuals majoring in a course of study other than education; provided, that such course of study meets the requirements for concentration and certification in a subject related to secondary education and that such individuals, in addition to courses required for their major, complete the minimum courses required for teacher certification in secondary education. The stipend amounts and repayment terms shall be the same as education majors under the provision of this Article. § 18203. Academic Advisor and Program Contract. Each Teacher Corps program participant shall have an academic advisor who, with the student, shall develop a complete academic plan that would result in the granting of a teaching degree within a normally prescribed period of time. This plan shall be examined by the appropriate University officials and the Educator Corps Administrator, and upon their 11 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS approval, shall constitute a contract between the student and the School of Education. § 18204. Prioritization of Scholarships According to Teaching Needs. The School of Education shall prioritize the granting of Teacher Corps Scholarships according to the teaching needs (subject area) as identified by the Department of Education and the Guam Community College. § 18205. Prior Rules and Law Shall Apply to Applicants Currently in the Program or Under Repayment Status. The laws and rules, in effect immediately prior to the date of enactment of this Article, governing those scholarship recipients enrolled in the scholarship program or are under repayment as of such date, shall apply notwithstanding the provisions of this Chapter. ---------ARTICLE 3 THE GUAM COUNSELOR CORP § 18301. § 18302. § 18303. § 18304. Composition of Guam Counselor Corps. Guam Counselor Corps Scholarship and Financial Assistance Program. Academic Advisor and Program Contract. Limitation on Number of Scholarships. § 18301. Composition of Guam Counselor Corps. (a) The Guam Counselor Corps shall consist of students who have declared their intention to become school guidance counselors and who are enrolled in the appropriate degree program at the University of Guam that is necessary for certification as a guidance counselor in the Department of Education or Guam Community College, or if such program is not available at the University of Guam, at other accredited institutions which have been approved by the School of Education and who have been duly accepted into the Guam Counselor Corps Scholarship Program. (b) Scholarship and financial assistance may be awarded to eligible students who meet the following criteria: (1) are bona fide residents of Guam; 12 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (2) are citizens or permanent resident aliens of the United States; (3) are graduates of baccalaureate degree program through an accredited college or university with an overall grade point average of not less than 2.5 on a 4.0 scale; (4) have been admitted to the Graduate School of the University of Guam in accordance to its admissions policies; (5) maintain an overall grade point average of 3.0 or better during the term of assistance under this program; (6) agree to practice guidance counseling in a public school funded by the government of Guam in areas of need upon graduation and certification to practice on Guam. (A) If no vacant guidance counseling positions exist in such public schools, a Counselor Corps graduate may work in a private school on Guam towards meeting their Counselor Corps scholarship repayment obligations. The Department of Education and the Guam Community College shall certify that no vacancies exist prior to allowing private school employment. (B) The length of commitment of service to Guam shall be one (1) year of service or pro-rated fraction thereof for every eighteen (18) semester hours of classes that the student has received the scholarship and financial assistance. (C) Only guidance counseling work in public schools funded by the government of Guam and/or Guam private schools licensed by the government of Guam shall be credited for repayment of the Counselor Corps scholarship. (D) (i) Those Counselor Corps graduates who were allowed to work in licensed private schools on Guam shall accept employment with the Department of Education should a position become available at the start of each semester until such time that their scholarship is repaid. (ii) The student further agrees that, in the event of refusal to fulfill this obligation, the student shall repay the government of Guam an amount equal to the balance of the total monthly allowances paid to the student which have not already been satisfied through service or payment, including 13 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS tuition, stipends and the actual cost to the government of textbooks and supplies. (iii) Any deferment of repayment through services shall conform to rules adopted by the School of Education under the provisions of § 18103(f) of this Chapter; (7) have been employed as a certified teacher for period of not less than two (2) years; (8) have received a recommendation from a school principal; and (9) must have paid off, through teaching service credit, at least two (2) years of all Teacher Corps scholarship obligations and any unpaid obligations from the Teacher Corps shall be added to the Counselor Corps obligations. 2015 NOTE: Subsection/subitem designations were added/altered to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. § 18302. Guam Counselor Corps Scholarship and Financial Assistance Program. (a) Students in the program must complete an application form provided by the School of Education and satisfy all the requirements set out in § 18101, supra. (b) A monthly allowance shall be paid to a person who is enrolled pursuant to the following schedule: (1) Part-time students enrolled in at least six (6) semester hours per semester, Two Hundred Dollars ($200.00) per month; full-time students enrolled in at least nine (9) semester hours per semester, Three Hundred Dollars ($300.00) per month; full-time students enrolled in at least twelve (12) semester hours per semester, Four Hundred Dollars ($400.00) per month; full-time students enrolled in at least fifteen (15) semester hours per semester, Five Hundred Dollars ($500.00) per month. (2) As a condition for continuing full entitlement to the benefits provided in this Chapter, recipients must maintain a minimum of either a part-time enrollment of six (6) semester credits per semester while working as a full-time teacher, or twelve (12) semester hours as a full- 14 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS time student, and good academic standing with a grade point average of 3.0 or better. (c) Registration, tuition and other related fees normally assessed by the University, and an allowance not to exceed the amount of Two Hundred Fifty Dollars ($250.00), shall be allowed per regular semester, and One Hundred Dollars ($100.00) per summer session in which a person is enrolled to cover costs of textbooks and supplies. § 18303. Academic Advisor and Program Contract. Each Counselor Corps program participant shall have an academic advisor who shall, with the student, develop a complete academic plan that results in the granting of a graduate degree, within a normally prescribed period of time, in the academic course of study necessary to attain certification as a guidance counselor in the Department of Education or the Guam Community College. This plan shall be examined by the appropriate University officials and the Educator Corps Administrator, and upon their approval, shall constitute a contract between the student and the School of Education. § 18304. Limitation on Number of Scholarships. The number of Counselor Corps Scholarships awarded during an academic year shall be limited to the current and anticipated needs as identified by the Department of Education and to the extent that funding is available. ---------ARTICLE 4 THE GUAM PRINCIPAL CORPS § 18401. § 18402. § 18403. § 18404. Composition of Guam Principal Corps. Guam Principal Corps Scholarship and Financial Assistance Program. Academic Advisor and Program Contract. Limitation on Number of Scholarships. 15 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS § 18401. Composition of Guam Principal Corps. (a) The Guam Principal Corps shall consist of students who have declared their intention to become school Principals or Assistant Principals and who are enrolled in the Education Administration and Supervision program at the University of Guam, or if such program is not available at the University of Guam, at other accredited institutions which have been approved by the School of Education and who have been duly accepted into the Guam Principal Corps Scholarship Program. (b) Scholarship and financial assistance may be awarded to eligible students who meet the following criteria: (1) are bona fide residents of Guam; (2) are citizens or permanent resident aliens of the United States; (3) are graduates of baccalaureate degree program through an accredited college or university with an overall grade point average of not less than 2.5 on a 4.0 scale; (4) have been admitted to the Graduate School of the University of Guam in accordance with its admissions policies; (5) maintain an overall grade point average of 3.0 or better during the term of assistance under this program; (6) agree to assume a position as a school principal or school assistant principal in a public school funded by the government of Guam in areas of need upon graduation and certification to practice on Guam. (A) If no vacant principal or assistant principal positions exist in such public schools, a Principal Corps graduate may work in a private school on Guam towards meeting their Principal Corps scholarship repayment obligations. The Department of Education shall certify that no vacancies exist prior to allowing private school employment. (B) The length of commitment of service to Guam shall be one (1) year of service or pro-rated fraction thereof for every eighteen (18) semester hours of classes that the student has received the scholarship and financial assistance. 16 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (C) Only work as a school principal or assistant principal in public schools funded by the government of Guam and/or Guam private schools licensed by the government of Guam shall be credited for repayment of the Principal Corps scholarship. (D) (i) Those Principal Corps graduates who were allowed to work in licensed private schools on Guam shall accept employment with the Department of Education should a position become available at the start of each semester until such time that their scholarship is repaid. (ii) The student further agrees that, in the event of refusal to fulfill this obligation, the student shall repay the government of Guam an amount equal to the balance of the total monthly allowances paid to the student which have not already been satisfied through service or payment, including tuition, stipends and the actual cost to the government of textbooks and supplies. (iii) Any deferment of repayment through services shall conform to rules adopted by the School of Education under the provisions of § 18103(f) of this Chapter; (7) have been employed as a certified teacher for period of not less than two (2) years; (8) have received a recommendation from the Director of Education or a District Superintendent; and (9) must have paid off, through teaching service credit, at least two (2) years of all Teacher Corps scholarship obligations and any unpaid obligations from the Teacher Corps shall be added to the Principal Corps obligations. 2015 NOTE: Subsection/subitem designations were added/altered to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. § 18402. Guam Principal Corps Scholarship and Financial Assistance Program. (a) Students in the program must complete an application form provided by the School of Education and satisfy all the requirements set out in § 18101, supra. 17 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (b) a monthly allowance shall be paid to a person who is enrolled pursuant to the following schedule: (1) Part-time students enrolled in at least six (6) semester hours per semester, Two Hundred Dollars ($200.00) per month; full-time students enrolled in at least nine (9) semester hours per semester, Three Hundred Dollars ($300.00) per month; full-time students enrolled in at least twelve (12) semester hours per semester, Four Hundred Dollars ($400.00) per month; full-time students enrolled in at least fifteen (15) semester hours per semester, Five Hundred Dollars ($500.00) per month. (2) As a condition for continuing full entitlement to the benefits provided in this Chapter, recipients must maintain minimum of either a part-time enrollment of six (6) semester credits per semester while working as a full-time teacher, or twelve (12) semester hours as a fulltime student and good academic standing with a grade point average of 3.0 or better. No student may receive benefits beyond the number of calendar years normally required to complete such student's program. (c) Registration, tuition, and other related fees normally assessed by the University and an allowance not to exceed the amount of Two Hundred Fifty Dollars ($250.00) shall be allowed per regular semester, and One Hundred Dollars ($100.00) per summer session in which a person is enrolled to cover costs of textbooks and supplies. § 18403. Academic Advisor and Program Contract. Yamashita Corps to Provide Financial Assistance to Enrollees in the Fifth-Year Induction Program. Composition of the Fifth-Year Induction Corps. Fifth-Year Induction Corps Scholarship and Financial Assistance Program. § 18501.Authorization for the Dr. Antonio C. Yamashita Corps to Provide Financial Assistance to Enrollees in the Fifth-Year Induction Program. The Dr. Antonio C. Yamashita Corps may provide financial assistance for new Department of Education teachers to participate in any program designed to assist new teachers offered by the University of Guam and approved by the Dr. Antonio C. Yamashita School of Education. § 18502. Composition of the Fifth-Year Induction Corps. The Fifth-Year Induction Corps may enroll first-year Department of Education teachers who meet the following criteria: (a) are bona fide residents of Guam; (b) are citizens or permanent resident aliens of the United States; (c) are either graduates of a baccalaureate degree program through an accredited college or university or must complete the Fifth-Year Teacher Mentoring and Induction Program to obtain their baccalaureate degree and have an overall grade point average of not less than 2.5 on a 4.0 scale; 19 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (d) have been admitted to the University of Guam Fifth-Year Mentoring and Induction Program in accordance to its admissions policies; (e) maintain an overall grade point average of 3.0 or better during the term of assistance under this Program; (f) The length of commitment of service to Guam shall be one (1) year of service or pro-rated fraction thereof for every eighteen (18) semester hours of classes that the student has received the scholarship and financial assistance. Due Diligence of the Dr. Antonio C. Yamashita Educator Corps. Rules and Regulations. § 18601. Legislative Findings and Intent. I Liheslaturan Guåhan finds that there are benefits to the Department of Education if educator recertification courses are targeted to improve the educator’s teaching methods, language arts and mathematics skills, knowledge of the specific subject matter being taught, ability to use computers and the internet, and to address the educational requirements for special needs students. I Liheslatura further finds that the recertification process for educators employed by the Department of Education requires them to periodically complete college level courses at their own personal expense. The policy is silent, however, on choice and subject matter of such courses and therefore may result in educators completing courses that would not improve their effectiveness. I Liheslatura intends to support educator recertification by offering an option that would provide full financial support for a structured curriculum, via the Dr. Antonio C. Yamashita Educator Corps, designed to improve teaching methods, increase proficiency in language arts and mathematics, increase proficiency in the teaching subject area, increase proficiency in the use of computers and the internet, and to address the educational requirements of special needs students. § 18602. Structured Curriculum Option. Educators selecting the Structured Curriculum Option shall be required to complete their recertification courses in any of the following areas: (a) Courses providing reinforcement of the educator’s instruction methods; (b) Courses providing reinforcement of the educator’s language arts or mathematics skill; (c) Courses providing reinforcement of the educator’s teaching subjects; 21 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS (d) Courses providing proficiency in the use of computers and the internet; and (e) Courses to prepare educators to address the educational needs of students with disabilities, as defined by the Individuals with Disabilities Education Act (IDEA), students whose primary language is one other than English, and the Gifted and Talented Students. Educators completing recertification courses under this option may select courses from one (1) or more of the five (5) categories herein. § 18603. Structured Curriculum Option: Approval of Course Listing. The allowable courses for each teaching class or teaching specialty shall be approved by the Dr. Antonio C. Yamashita School of Education. The educator must meet the admission prerequisite requirements of the educational institution for such courses. § 18604. Structured Curriculum Option: Benefits. Educators selecting the Structured Curriculum Option for recertification shall be entitled to the payment of tuition, books and fees by the Dr. Antonio C. Yamashita Educator Corps. The allowance for books shall be based on a prorated formula based on course load relative to the amount allowed for books of full-time students in the “Teacher Corps” component of the Dr. Antonio C. Yamashita Educator Corps. The amount of tuition and fees for courses herein shall be the lower of the actual cost of tuition and fees, or the amount of the tuition and fees for similar level courses charged by the University of Guam. § 18605. Special Group Rates. The School of Education may negotiate with the University of Guam and the Guam Community College for discounted group rates for tuition and fees for courses meeting the criteria herein. § 18606. Funding for Education Research Dissemination (ERD) Courses. The Dr. Antonio C. Yamashita Educator Corps is authorized to pay for tuition and fees for Education Research Dissemination (ERD) courses offered through the Guam Federation of Teachers (GFT), provided that such courses are consistent with the provisions of §§ 18602 herein, and that the 22 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS payment of tuition and fees does not exceed the cost of tuition and fees charged to GFT members for such courses. § 18607. Conditions of Acceptance. Educators accepted into this program herein shall agree to the following conditions: (a) To successfully complete the courses; (b) That the educator will remain employed by the Department of Education in the position for which the educator is seeking recertification for a period of not less than one (1) semester for every three (3) credits of support received herein; (c) Present an eligibility certificate from the Department of Education that includes the educator’s present teaching concentration; (d) Comply in a timely fashion with the Department of Education certification requirements; and (e) Agree to repay the Dr. Antonio C. Yamashita Educator Corps for benefits provided if the conditions of this Section are not met. § 18608. Funding. Funding for the Dr. Antonio C. Yamashita Educator Corps to administer and conduct the program in this Article may come from any or all of the following sources: (a) Direct appropriation by I Liheslaturan Guåhan for the express purpose of funding the program created by this Article; (b) Appropriations made to the Dr. Antonio C. Yamashita Educator Corps; (c) Collections of past due amounts resulting from participants’ failure to complete service credit requirements; (d) The operation budget of the Department of Education for staff development; (e) Federal funds secured by the Department of Education for staff development; and (f) Any other source of funding for which the use of money for the purposes herein is consistent with law. 23 COL622016 17 GCA EDUCATION CH. 18 YAMASHITA EDUCATOR CORPS § 18609. Due Diligence of the Dr. Antonio C. Yamashita Educator Corps. (a) The Dr. Antonio C. Yamashita School of Education shall, within sixty (60) days after the enactment of this Act, submit to I Liheslaturan Guåhan and I Maga’lahen Guåhan a strategic plan review of existing scholarship funding levels, continuing appropriations, anticipated collections, projected expenditures and projected contributions of the Dr. Antonio C. Yamashita School of Education in carrying out the provisions of this Article. (b) The Dr. Antonio C. Yamashita School of Education shall limit the numbers of participating educators according to available funding levels. (c) The Dr. Antonio C. Yamashita School of Education shall provide the legislative committee with oversight over student financial assistance and legislative committee with oversight over the government of Guam budget, semester reports of participation and financial needs to carry out the provisions of this Article. (4) The Dr. Antonio C. Yamashita Educator Corps shall apply its best management efforts to reduce operating costs and expenditures in meeting the objectives of this Article. 2015 NOTE: Subsection designations were added to adhere to the Compiler’s codification scheme in accordance with the authority granted by 1 GCA § 1606. § 18610. Rules and Regulations. The Dr. Antonio C. Yamashita Educator Corps shall promulgate Rules and Regulations for the program in this Article. ---------ARTICLE 7 SUNSET PROVISION SOURCE: Article added by P.L. 30-073:3 (Nov. 27, 2009). § 18701. Sunset Provision of Scholarships Awarded Under this Chapter. No new scholarships shall be awarded under the provisions of this Chapter after the Academic Year 2009-2010.
