15 GCA ESTATES AND PROBATE CH. 48 APPEALS CHAPTER 48 APPEALS § 4801. Appealable Orders. § 4802. Effect of Appeal. § 4801. Appealable Orders. An appeal may be taken to the Supreme Court of Guam from an order granting or revoking letters of guardianship settling an account of a guardian or refusing to make any order heretofore mentioned in this Section. SOURCE: Probate Code of Guam (1970), § 1630. COMMENT: (1994) Pursuant to an Organic Act amendment in 1984, the Legislature, by P.L. 21-147, established a new, authorized, Supreme Court of Guam. Section 5 of that Act directed that all references to the Appellate Division of the District Court henceforth read the Supreme Court of Guam. Therefore, this section is changed accordingly. § 4802. Effect of Appeal. An appeal from an order appointing a guardian for an insane or incompetent person shall stay the power of the guardian, except that, for the purpose of preventing injury or loss to person or property, the court making the appointment may direct the exercise of the powers of the guardian, from time to time, as though no appeal were pending, and all acts of the guardian pursuant to such directions shall be valid, irrespective of the result of the appeal.
