Legislative Intent. Nomenclature of Act. Catastrophic Leave, Authorized. Catastrophic Leave Pool, Created. Catastrophic Leave Pool Rules and Regulations, Authorized. § 17101. Legislative Intent. It is the intent of I Liheslaturan Guåhan to allow employees who have been certified as having a catastrophic illness to receive donated sick leave in excess of the maximum allowed under the Family and Medical Leave Act of twelve (12) weeks in any twelve (12) month period. I Liheslatura intends to create a separate pool into which donated sick leave hours may be deposited in order to accomplish this intent. The procedures on accessing these donated hours shall mirror the established procedures for leave sharing, with the exception of the cap on the number of weeks that an employee can receive in donated hours, the number of weeks that can be donated, and the need to designate the recipient of the donated hours. § 17102. Nomenclature of Act. This Chapter may be cited as the “Catastrophic Leave Pool Act of 2015.” § 17103. Catastrophic Leave, Authorized. Notwithstanding the provisions of § 8.800 of Chapter 1 of Division 1, Title 2 GARR, the Family and Medical Leave Act, an employee who has been certified by a physician to have a catastrophic illness shall be eligible to receive donated sick leave from the Catastrophic Leave Pool. § 17104. Catastrophic Leave Pool, Created. The Department of Administration is authorized to establish and maintain a “Catastrophic Leave Pool” into which shall be deposited donated 1 COL622016 4 GCA PUBLIC OFFICERS & EMPLOYEES CH. 17 CATASTROPHIC LEAVE POOL ACT sick leave hours. For the purposes of this Section, there shall be no limitation on the number of hours that can be donated to the Pool. § 17105. Catastrophic Leave Pool Rules and Regulations. The Department of Administration shall promulgate such rules and regulations pursuant to the Administrative Adjudication Law as may be necessary to carry out the intent of this Act and shall, to the extent practicable, utilize the rules and regulations established for the Family and Medical Leave Act. ---------- 2 COL622016
