17 GCA EDUCATION CH. 10 Y KUENTAN S ALAPPE’ PRINSEPAT CHAPTER 10 Y KUENTAN SALAPPE’ PRINSEPAT (PRINCIPAL’S FUND) SOURCE: Chapter 10 was added by P.L. 21-136:IV:14. 2009 NOTE: P.L. 28-045:10 (June 6, 2005) changed the name of the Department of Education to the Guam Public School System. P.L. 30-050:2 (July 14, 2009) reverted the name of the Guam Public School System to the Department of Education. References to Guam Public School System have been changed to Department of Education pursuant to P.L. 30-050:3. § 10101. Legislative Intent. § 10102. Creation of Y Kuentan Salappe’ Prinsepat (Principal’s Fund). § 10103. Y Kuentan Salappe’ Prinsepat to be Placed in Office of the Superintendent of Schools Budget Request. § 10104. Reversion of unexpended funds to General Fund. § 10105. Accountability of Funds. § 10106. Level of Funding. § 10101. Legislative Intent. The Legislature is aware of a growing problem that principals in our public schools have encountered over the years in reference to funding and purchasing of small miscellaneous items for the school’s needs. Any item in need by the schools, for example, light bulbs, toilet accessories, and so forth, has to be requested through the Office of the Superintendent of Schools’s Procurement Office, and many times several weeks or several months pass before receipt of the item. This problem is primarily a factor of the lengthy procurement process which principals and other public school administrators have to go through in requesting necessary materials and supplies. In order to immediately address the funding of these miscellaneous items for the principals and to reduce the excessive number of requests submitted to the Department’s Procurement Office, the Legislature desires to create a principal’s fund, primarily for funding these year-round items which address immediate small problems. § 10102. Creation of Y Kuentan Salappe’ Prinsepat (Principal’s Fund). There is created a fund to be known as the “Y Kuentan Salappe’ Prinsepat”, which is an allocation to each public school in the amount of Fifty Dollars ($50.00) per student enrolled in each respective school, placed under the control of the principal of each school who shall be the designated 1 COL 110609 17 GCA EDUCATION CH. 10 Y KUENTAN S ALAPPE’ PRINSEPAT purchasing officer for purchases made under the fund. The fund shall be used to purchase small miscellaneous items for direct school maintenance and repairs and for classroom and library materials, supplies and equipment in accordance with Chapter 3 of the Procurement Regulations of the Office of the Superintendent of Schools. SOURCE: Amended by P.L. 23-128:IV:29(a). § 10103. Y Kuentan Salappe’ Prinsepat to be Placed in Office of the Superintendent of Schools Budget Request. The appropriation request for Y Kuentan Salappe' Prinsepat shall be included in the budget request for the Office of the Superintendent of Schools, and shall be listed as individual requests under each school's budget. § 10104. Reversion of Unexpended Funds to General Fund. Any unexpended funds at the end of the fiscal year in which they are appropriated shall revert to the General Fund at the end of that fiscal year. § 10105. Accountability of Funds. Each principal shall be accountable for the specific application of Y Kuentan Salappe' Prinsepat funds. Receipts and records of the purchase of the items shall be made into a balance sheet and submitted to the Director of Education on January 15, April 15, June 15 and September 30 of each year. If any principal is unable to provide receipts or proof of expenditure of funds, this shall subject the principal to civil or criminal penalties. The principal of each school will be held personally liable for any unaccounted funds. Inability of any principal to account for the expenditures of these funds, or the spending of the funds for unauthorized purposes, shall be reported to the Attorney General's office for disposition, and shall subject the principal to disciplinary action if warranted. SOURCE: Amended by P.L. 23-128:IV:29(b). § 10106. Level of Funding. The level of yearly funding in the Y Kuentan Salappe' Prinsepat may change upon Legislative appropriation. § 10107. Appropriation. The amount of One Million Six Hundred Ninety-one Thousand One Hundred Fifty Dollars ($1,691,150) is hereby allotted to the fund "Y Kuentan Salappe' Prinsepat", established pursuant to Section 10102 of 2 COL 110609 17 GCA EDUCATION CH. 10 Y KUENTAN S ALAPPE’ PRINSEPAT Chapter 10, Title 17 of the Government Code of Guam. Those schools with enrollments of One Hundred (100) to Five Hundred (500) students will be allocated funds for Five Hundred (500) students. Schools with enrollments of Five Hundred One (501) or greater will be allocated funds based on actual enrollment. Within the Fiscal Year 1997 Office of the Superintendent of Schools “Y Kuentan Salappe’ Prinsepat” budget category are funds allotted at a rate of Fifty Dollars ($50) per student with the exception of the following schools with student populations at less than Five Hundred (500) which will receive a minimum of Twenty Five Thousand Dollars ($25,000) per school. These schools are as follows: F.Q. Sanchez (120); Inarajan Elementary (399); Merizo Elementary (354); J.P. Torres (338); Talofofo Elementary (359); and, L.B. Johnson (416) funding for Salappe' Prinsepat. The funds shall be made available in two installments, payable in an amount equal to the number of students officially registered at each school as reported in September and February, except for schools stated above. This category, “Y Kuentan Salappe’ Prinsepat”, shall be exempt from any administrative transfer authority granted or authorized pursuant to this Act SOURCE: Added by P.L. 23-128:IV:29(c). --------- 3 COL 110609
