Title. Legislative Intent. Establishment. Definitions. Director: Duties. Personnel Recruitment. Annual Reporting. Cooperation from Other Agencies. Assistance from Federal Government and Others. Prohibits Duplication. § 21101. Title. This Chapter may be cited as the Guam Tropical Plants Development Act. SOURCE: '11899.1 GC, as added by P.L. 13-192. § 21102. Legislative Intent. The Legislature finds it is practical and realistic to develop agriculture as a revenue-producing segment of the economy of Guam but to achieve this goal certain basic objectives must be set and impetus given for the accomplishment of these objectives. The objectives of the Guam Tropical Plants Development Facility shall be: (a) To provide a constant reliable source of staple food at low cost; (b) To establish a tropical plant bank or germplasm to propagate seedlings, grafts and cross breedings which scientists throughout the world can use for information and research; (c) To serve as a tropical plants research laboratory; (d) To serve as a tropical plants experimental, educational and demonstration site; (e) And to serve as a general attraction for visitors. In carrying out the objectives above set for the Guam Tropical Plants Development Facility shall keep in mind that it is the finding of the Legislature that the overall objective shall be the development and 1 COL120106 17 GCA EDUCATION CH. 21 GUAM TROPICAL PLANTS DEVELOPMENT F ACILITY establishment of cash food crops which shall be rich in nutrients, hardy and easily cultivated. The Guam Tropical Plants Development Facility is directed to focus its research capabilities upon such tropical plants as breadfruit, mangoes, avocados, citrus, pineapples, bananas, papaya and exotic crops and other plants as may assist the Facility in the accomplishment of its mission. There is established within the University of Guam as a part of the College of Agriculture and Life Sciences the Guam Tropical Plants Development Facility. SOURCE: '11899.3 GC, as added by P.L. 13-192. § 21104. Definitions. (a) University shall mean University of Guam. (b) Facility shall mean the Guam Tropical Plants Development Facility. (c) Director shall mean the Director of the Guam Tropical Plants Development Facility, who shall be designated by the President of the University. The Director shall organize the Facility to engage in: (a) Research and experimentation; (b) Demonstration programs; and (c) Conduct educational programs for the purposes set out in § 21102. The Director shall have the power to employ academic and nonacademic personnel to be employed within the Facility subject to legislative appropriation. The Director is specifically encouraged to recruit for assistance in the accomplishment of the objectives of the Facility qualified scientists who during the basis of short-term employment may make significant contributions to the objectives of the Facility. 2 COL120106 17 GCA EDUCATION CH. 21 GUAM TROPICAL PLANTS DEVELOPMENT F ACILITY SOURCE: '11899.6 GC, as added by P.L. 13-192. § 21107. Annual Reporting. The Director shall annually report in writing to the Legislature and the Governor upon the work of the Facility. SOURCE: '11899.7 GC, as added by P.L. 13-192. § 21108. Cooperation from Other Agencies. All agencies and officials of the Government are authorized and empowered and shall cooperate with the Facility to the extent necessary to facilitate the exercise by the Facility of its powers, duties and functions under this Chapter. The Director, subject to approval of the President of the University, is authorized to enter into agreements with the Federal Government and its agencies and private foundations and international agencies to receive assistance of all kinds for the achievement of its objectives; provided, however, that the Director shall not enter into any agreement which requires the utilization or expenditure of local matching funds without the concurrence of the Legislature, which concurrence shall be in the form of a resolution duly adopted by the Legislature.
