(a) There is hereby created within the Guam Police Department of the territory of Guam the Civilian Volunteer Police Reserve, which shall be headed by the Chief of Police, hereinafter referred to as the Chief of Police. (b) The Chief of Police, subject to the advice and control of the Governor, shall be responsible for carrying out the purpose of this Chapter, and shall have such additional duties and responsibilities as are authorized herein, or as may be prescribed by the Governor. (a) The general functions and duties of the Civilian Volunteer Police Reserve shall be to provide backup manpower for the suppression of crime, preservation of law and order, fight and control fires and to assist in civil emergencies. 1 COL10/29/2021 10 GCA HEALTH AND SAFETY CH. 66 CIVILIAN VOLUNTEER POLICE RESERVE (b) The Chief of Police shall formulate a program whereby the Civilian Volunteer Police Reserve shall adhere to the functions and duties herein prescribed. From time to time the Chief of Police shall review and revise the functions and duties of the Civilian Volunteer Police Reserve to insure an amicable discharge of responsibilities and duties knowing the fact that their roles are the extension of duties of the regular personnel. (a) The Chief of Police shall recruit on an entirely volunteer basis, local residents who desire to make available their services to assist the Guam Police Department in carrying out its crime prevention, fire control and emergency functions. (b) The Chief of Police shall further promulgate rules and regulations regarding the age, health and other requirements for recruitment purposes. (c) Nothing in this Section shall prohibit the Chief of Police from recruiting a resident who is a non-immigrant alien admitted into Guam under the Compacts of Free Association between the United States and the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau. Training, Equipping and Maintenance of Records. (a) Training for the Civilian Volunteer Police Reserve members shall be conducted pursuant to the provision of the Peace Officer Standards and Training (POST) Commission in Chapter 51 of 17 GCA. Initial training requirements shall be identical to those required of Guam Police Officer cadets. (b) The Chief of Police shall maintain a roster of volunteers 2 COL10/29/2021 10 GCA HEALTH AND SAFETY CH. 66 CIVILIAN VOLUNTEER POLICE RESERVE who have received the training prescribed by Chapter 51 of 17 GCA. In order to maintain membership in the Reserve, each member must keep up with his scheduled training, and no volunteer may remain in the Reserve if he or she is unable to keep up with or otherwise absorb the training. Additionally, basic supplies and equipment shall be provided to assure a constant operability of the Civilian Volunteer Police Reserve, including a continuing program for replacement. (c) Members of the Civilian Volunteer Police Reserve who were recruited and sworn in from the fifteenth (15th) through the eighteenth (18th) cycles shall have up to two (2) years from the effective date of this Subsection to complete the POST training requirements required. (d) Any member of the Civilian Volunteer Police Reserve who has not met the minimum qualifications/certifications for firearms safety and proficiency, physical fitness, recruitment clearances (police, court, etc.), and background checks shall not be allowed to serve in the Civilian Volunteer Police Reserve. Whenever either the police or fire units of the Civilian Volunteer Police Reserve, and the members thereof are rendering assistance to the police or fireman, as the case may be, such volunteers shall have the same powers, duties, rights (including coverage under the Worker’s Compensation Act), privileges and immunities, as if they were paid, full-time members of the Guam Police Department, except that they shall earn recruitment credit for services performed as volunteers. Each member of the civilian Volunteer Police Reserve who successfully completes probationary requirements as established 3 COL10/29/2021 10 GCA HEALTH AND SAFETY CH. 66 CIVILIAN VOLUNTEER POLICE RESERVE by the Chief of Police, and who contributes a minimum of fortytwo hours or more per month, shall receive an allowance of Five Hundred Dollars ($500) per month, to defray the cost of maintenance of their equipment and uniforms. The Guam Police Department shall identify funds within their department appropriations to satisfy the intent of this Section. (a) The Guam Police Department (GPD) may employ CVPR Officers on a temporary, full-time basis, if such Officers are active members and have attained at least two thousand eighty (2,080) cumulative service hours, if a critical need arises because of military activation of police officers or absence due to a long-term disability status which has been certified by a medical doctor. The GPD may exercise this authority provided its authorized budget for personnel is not exceeded. The CVPR Officer shall return to volunteer status pursuant to this Chapter when the incumbent returns from military service or long-term disability, or at the discretion of the Chief of Police. (b) CVPR Officers may only serve as equivalent of Police Officer I and be compensated hourly only as a Police Officer I, Step I, and shall be eligible to receive sick leave, and be eligible for the Government of Guam Health Insurance Program, and shall not be eligible for a stipend as a Reserve Officer for the duration of their temporary employment by the Department. (d) Notwithstanding § 77114(a)(1) of Article 1, Chapter 77 of Title 10 GCA, a CVPR Officer who serves as a Police Officer I, Step I, under this Section may be a non-immigrant alien admitted into Guam under the Compacts of Free Association between the United States and the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau. Same: Eligibility and Oath. (a) No person shall be a volunteer member of the Civilian Volunteer Police Reserve established under this Chapter who advocates a change by force or violence in the constitutional form of the Government of the United States or in this Territory or the overthrow of any government in the United States by force, or who has been convicted of or is under indictment or information charging any subversive act against the United States. (b) Every volunteer shall, entering upon his duties, take an oath, in writing, before a person authorized to administer oaths in this Territory, which oath shall be substantially as follows: “I _____________________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the laws of the territory of Guam, against all enemies, foreign or domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter and I do further swear (or affirm) that I do not advocate, nor am I a member of any political party or organization that advocates the overthrow of the Government of the United States or of this Territory by force or violence; and that during such time as I am a member of the Civilian Volunteer Police Reserve I will not advocate nor become a member of any political party or organization that advocates the overthrow of the Government of the United States or of this Territory by force or violence.” SOURCE: GC § 8965, as repealed and reenacted by P.L. 13-140 (Mar. 3, 1976). 2017 NOTE: Subsection designations added pursuant to the authority of 1 GCA § 1606. § 66106. Rules and Regulations: Recommendations.
