3 GCA ELECTIONS CH. 5 ELECTION DAYS AND DATES CHAPTER 5 ELECTION DAYS AND DATES NOTE: Unless otherwise noted, all sections within this chapter were included in the original Government Code of Guam enacted by P.L. 1-088 (Nov. 29, 1952), and repealed and reenacted by P.L. 7-164 (Aug. 28, 1964). During the Fifteenth Guam Legislature, the Compiler announced that Title 3 - Elections had been added to the new, permanent Guam Code Annotated. See 4 Guam Sess. L. Introduction (Mar. 1981). § 5101. § 5102. § 5103. § 5104. § 5105. General Election for Liheslatura (Legislature). Regular Election for Other Officials. Postponement of Election. Proclamation for Special Election. Publication and Posting of Notices for Special Election. § 5101. General Election for I Liheslatura (the Legislature). The general election for I Liheslaturan Guåhan (the Guam Legislature) shall be held on the Tuesday next after the first Monday in November, biennially in even numbered years. Those elected at such a general election shall be eligible to take office from the day the Commission certifies their due election, which shall be within the ten (10) calendar days following such election, to the next election held in accordance with the laws of Guam and until their successors have been duly qualified. On the Tuesday next after the first Monday in November, in every even numbered year, a regular election shall be held to elect municipal and other public officials at large as heretofore or hereafter may be required by law in accordance with this Title. The terms of office for such officials shall be in accordance with the laws creating such elective Offices. SOURCE: GC § 2151. Codified as 3 GCA § 5102. If for serious cause resulting from any natural phenomenon, or act of God, or of public enemy, it becomes reasonably impossible to hold any 1 07312013 3 GCA ELECTIONS CH. 5 ELECTION DAYS AND DATES election duly scheduled on Guam as a whole, or in any municipality or municipal division, I Maga’låhen Guåhan or I Liheslaturan Guåhan with the advice and consent of I Liheslatura (the Legislature), upon the recommendation of the Commission, may postpone any such election therein for such time as they may deem necessary, but in no event shall such postponement exceed thirty (30) days from the date when such election should have been held. If additional time is necessary, the election may be postponed pursuant to the manner described in this Section. SOURCE: GC § 2152. Codified as 3 GCA § 5103. Repealed and reenacted by P.L. 31-255:2 (Dec. 11, 2012). § 5104. Proclamation for Special Election. At least thirty (30) days before any special election, I Maga’låhen Guåhan shall publish an election proclamation, and transmit copies to the Commission. The proclamation shall contain a statement of the date and time of election, and of the office or offices to be filled. SOURCE: GC § 2154. Codified as 3 GCA § 5104. Repealed and reenacted by P.L. 31-255:2 (Dec. 11, 2012). § 5105. Publication and Posting of Notices for Special Election. Upon receipt of the special election proclamation, the Commission shall cause a copy to be published in a newspaper of general circulation, and to be posted in each municipality where such special election will take place, at least twenty (20) days before the scheduled date of the election.
