Bonus for Wake Island Guamanian Workers. Article 4. Bonus for Civilian Scouts. ARTICLE 1 VETERANS BONUSES § 68100. Veterans and Beneficiaries Entitled to Bonus; Amounts. § 68101. Application for Bonuses. § 68102. Rules and Regulations. § 68100. Veterans and Beneficiaries Entitled to Bonus; Amounts. (a) Every person who served in active duty in the Armed Forces of the United States in World War II, the Korean War or the Indo-China Conflict, who at the time of entering such service, was a resident of Guam and who was separated or discharged from his or her respective branch of service under conditions other than dishonorable or who is still in active or reserve service shall be entitled to receive a bonus of Thirty Dollars ($30.00) for each month of active service during World War II, the Korean War or IndoChina Conflict. The bonus for a fraction of a month of service shall be determined on the basis of One Dollar ($1.00) for each day of service, except that bonuses shall not be given to any person who received from another state or territory of the United States a bonus of a like nature as is provided in this Chapter. The maximum payment under this Chapter shall not exceed the sum of Seven Hundred Twenty Dollars ($720.00). (b) If a veteran is entitled to a Guam veterans bonus under this Chapter and if he or she is not living, the amount of compensation to which the veteran would be entitled shall be paid to his beneficiaries in this order: (1) To the living spouse, except where at the time of the death of the veteran, either: (i) the veteran and his spouse were separated by consent as defined in § 99 of the Civil Code of Guam; or (ii) the spouse had deserted the veteran as defined in § 95 of the Civil Code of Guam; or 1 COL120106 10 GCA HEALTH AND S AFETY CH. 68 VETERANS BONUSES (2) If there is not eligible living spouse, such compensation shall be paid to the living child or children of the deceased veteran to share and share alike; or (3) If there is no living child or children, the compensation shall be paid to the living mother; or (4) If there is no living mother, the compensation shall be paid to the living father; or (5) If there are no eligible living beneficiaries as set forth above, to the estate of the veteran. (c) If a veteran is entitled to a Guam Veterans bonus under this Article and he or she was killed in action, the amount of compensation payable under (b) above shall be Seven Hundred Twenty Dollars ($720.00). All application for bonuses authorized by this Article must be made to the Office of Veterans Affairs on or before December 31, 1986. Each applicant shall furnish to the Office of Veterans Affairs evidence of his eligibility for a veterans bonus. Eligibility may be evidenced by authenticated copies of records of certificates issued by the Department of Defense, U.S. Military Service Department or any other authorized agency having such evidence in its possession. The Veterans Affairs Officer of the Office of Veterans Affairs, government of Guam, pursuant to the provisions of the Administrative Adjudication Act, shall issue all lawful rules and regulations needed to implement the provisions of this Article, including, without limitation, criteria governing length of service and type of discharge, defining the beginnings and ends of World War II, the Korean War and the Indo-China Conflict, and establishing priority for payment as follows: World War II veterans, Korean War veterans and the Indo- China Conflict veterans. SOURCE: GC § 8983. ---------- 2 COL120106 10 GCA HEALTH AND S AFETY CH. 68 VETERANS BONUSES ARTICLE 2 BONUS FOR VETERANS OF GUAM COMBAT PATROL § 68200. Creation of Bonus. § 68201. Eligibility for a Bonus. § 68200. Creation of Bonus. In honor of the Guam Combat Patrol, which has received inadequate recognition from the United States Government, and little prior recognition from the government of Guam, they are hereby authorized to be paid to each veteran of the Guam Combat Patrol, or his survivor or survivors, bonuses in the amount of Two Thousand Five Hundred Dollars ($2,500.00). SOURCE: GC § 8985. § 68201. Eligibility for a Bonus. The Director of Public Safety shall prepare a list of all bona fide veterans of the Guam Combat Patrol, which list shall govern eligibility for bonuses authorized by this Article. Each eligible veteran, or his survivor or survivors, shall apply for such bonuses to the Director of Public Safety, who upon satisfactory proof that such applicants are veterans of the Guam Combat Patrol or are such a bona fide veterans survivor or survivors, shall certify to the Treasurer of Guam the eligibility of such applicants for such bonuses, and the Treasurer shall thereupon pay such bonuses to such applicants. SOURCE: GC § 8986. ---------ARTICLE 3 BONUS FOR WAKE ISLAND GUAMANIAN WORKERS § 68300. Creation of Bonus. § 68301. Eligibility for a Bonus. § 68300. Creation of Bonus. In honor of the Wake Island Workers who have received inadequate recognition from the United States Government, and little prior recognition from the government of Guam, there are hereby authorized to be paid to each of the Wake Island Workers, or his survivor or survivors, bonuses in the amount of Two Thousand Five Hundred Dollars ($2,500). 3 COL120106 10 GCA HEALTH AND S AFETY CH. 68 VETERANS BONUSES SOURCE: GC § 8989, as added by P.L. 15-119. § 68301. Eligibility for a Bonus. The Governor shall prepare a list of all bona fide Wake Island Workers, which list shall govern eligibility for bonuses authorized by this Article. Each eligible worker, or his survivor or survivors, shall apply for such bonuses to the Governor, who upon satisfactory proof that such applicants were Wake Island Workers or are such a bona fide worker's survivor or survivors, shall certify to the Treasurer of Guam the eligibility of such applicants for such bonuses, and the Treasurer shall thereupon pay such bonuses to such applicants. No Payment to Those Assisting Applicants. § 68403. Members of the Legislature and Others Ineligible. § 68400. Creation of Bonus. In honor of those local residents who served as civilian scouts for the United States Armed Forces during the liberation of Guam in the Second World War, who have never received adequate recognition from either the United States or the territory of Guam, there is hereby authorized to be paid to each such civilian scout, or his survivor or survivors, a bonus in the sum of Two Thousand Five Hundred Dollars ($2,500.00). SOURCE: GC § 8990. § 68401. Eligibility for Bonus. (a) If a person is entitled to a Guam Civilian Scout Bonus and if he is not living, the amount of compensation to which the person would be entitled shall be paid to his beneficiaries in this order: 1. To the living spouse, except where at the time of the death of the civilian scout, either: (a) the civilian scout and his spouse were separated by consent as defined in § 99 of the Civil Code of Guam; or 4 COL120106 10 GCA HEALTH AND S AFETY CH. 68 VETERANS BONUSES (b) the spouse had deserted the civilian scout as defined in § 95 of the Civil Code of Guam; or 2. If there is no eligible living spouse, such compensation shall be paid to the living child or children of the deceased civilian scout to share and share alike; or 3. if there is no living child or children, the compensation shall be paid to the living mother; or 4. if there is no living mother, the compensation shall be paid to the living father; or 5. if there are no eligible living beneficiaries as set forth above, to the estate of the civilian scout. (b) All applications for the bonuses authorized by this Article must be made to the Chief of Police on or before March 31, 1981. (c) The Chief of Police, upon satisfactory proof that such applicants were civilian scouts or are such a civilian scout's survivor or survivors, shall certify to the Treasurer of Guam the eligibility of such applicants for such bonuses, and the Treasurer shall thereupon pay the same to them. The Chief of Police shall promulgate, pursuant to the provisions of the Administrative Adjudication Act, such rules and regulations as are required to establish eligibility for such bonus by way of documentary evidence of such civilian scout service, affidavits based on personal knowledge, or such other proof as would establish by a preponderance of the evidence the fact of eligibility for such bonus. COMMENT: References to "Director of Public Safety" changed to "Chief of Police" pursuant to P.L. 17-78:1, which repealed '5102 GC providing for the Department of Public Safety and reenacted '5102 establishing the Guam Police Department. § 68402. No Payment to Those Assisting Applicants. No person may charge any fee or collect any commission for assisting an applicant for such bonus to prove eligibility or obtain the bonus. Any contract in violation of this Section shall be void, and any person who shall collect any fee or commission in violation of this Section shall be guilty of a misdemeanor punishable by a fine of not to exceed Five Hundred Dollars ($500.00), or by imprisonment for not to exceed six (6) months, or by both such fine and imprisonment. Notwithstanding any other provision of this Chapter, no member of the Tenth Guam Legislature, and no person who received the bonus under Article 2 of this Chapter, shall be eligible for the bonus authorized herein, but any member of the Legislature otherwise entitled thereto shall in lieu of such bonus be given an appropriate certificate of appreciation.
