Court restricted to determining whether challenged activity exempt from antitrust liability. —

Whether restrictive covenants in an insurance agency contract precluding agent from engaging in any other business or occupation for remuneration or profit without written consent of insurance company is a good policy is not a decision for the United States Court of Appeals for the fifth circuit to make; rather, the United States Court of Appeals is merely required to determine if the challenged activity is the business of insurance and, thus, exempt from antitrust liability, because Congress has determined that the states are the proper regulators of such business activity. Thompson v. New York Life Ins. Co., 644 F.2d 439, 1981 U. S. App. LEXIS 13615 (5th Cir. 1981).
