On July 8, 2019, in the Superior Court of Fulton County, Georgia, docketed at Civil Action File No. 2019CV322341, in the matter of Private Colleges and Universities Authority, the Corporation of Mercer University and Emory University v. Brian Kemp, in His Individual Capacity, Christopher M. Carr, in His Individual Capacity, an order was issued ruling on the constitutionality of Ga. L. 2019, p. 919 (HB 553).

Ga. L. 2024, p. 120, § 3-1/HB 985, not codified by the General Assembly, provides: “An Act repealing provisions creating inactive boards, panels, authorities, centers, commissions, committees, councils, task forces, and other such bodies, approved May 7, 2019 (Ga L. 2019, p. 919), is amended by repealing Part VII, relating to the Private Colleges and Universities Authority, pursuant to Private Colleges and Universities Authority, et al., v. Kemp (July 8, 2019) (docketed at Civil Action File No. 2019CV322341).” As a result, these formerly repealed provisions are now restored.
