Opinion Notes

OPINIONS OF THE ATTORNEY GENERAL School superintendent and county board constitutional offices. —

Ga. Const. 1945, Art. VIII, Sec. IX, Paras. I and II (see now Ga. Const. 1983, Art. VIII, Sec. V, Paras. II and III) did not purport to disturb the comprehensive code of statutory school laws other than to make the offices of the county school superintendent and the county board of education constitutional rather than statutory offices. 1958-59 Ga. Op. Att'y Gen. 143.

No statute prohibits county board from employing county superintendent as one of teachers in schools

of the county, so long as the board, in the discharge of the board’s duties, finds that the employment of the superintendent as a teacher would not conflict with duties as the superintendent. 1945-47 Ga. Op. Att'y Gen. 150.

County school superintendent is entitled to the benefits of the Teachers’ Retirement Act (O.C.G.A. § 47-3-1 et seq.).

County school superintendent not required to retire at 70. —

Elective officers, such as the county school superintendent, under the Teachers’ Retirement Act (O. C. G. A. § 47-3-1 et seq.) are not required to retire upon attaining the age of 70. 1945-47 Ga. Op. Att'y Gen. 152.
