Chapter 37 - Guaranteed Energy Savings Performance Contracting

L. 2010, p. 1091, § 3/SB 194, not codified by the General Assembly, provides, in part, that: "Section 2 of this Act shall become effective on January 1, 2011; provided, however, that Section 2 of this Act shall only become effective on January 1, 2011, upon the ratification of a resolution at the November, 2010, state-wide general election, which resolution amends the Constitution so as to authorize obligations of the state for governmental energy efficiency or conservation improvement projects in which vendors guarantee realization of specified savings or revenue gains attributable solely to the improvements. If such resolution is not so ratified, Section 2 of this Act shall not become effective and shall stand repealed in its entirety on January 1, 2011." The constitutional amendment (Ga. L. 2010, p. 1264) was approved by a majority of the qualified voters voting at the general election held on November 2, 2010.
