§ 38-2-195. Use of Armories and Other Facilities

  1. Armories and other facilities which are owned, leased, and operated by the state will not be used at any time by others when the use will interfere in any way with the functions and training of the organized militia unit or units occupying the same.
  2. The use of armories and other facilities shall be in accordance with regulations issued pursuant to this part.
  3. Armories and other facilities of the organized militia shall not be used for political or religious purposes, except that an armory may be used for the purpose of holding the national or state convention of a political party with the prior approval of the adjutant general.

OPINIONS OF THE ATTORNEY GENERAL

Use as polling places.

- National Guard armories may be used as polling places in an election, unless the use would interfere in any way with the functions and purposes for which the armory is primarily intended. 1969 Op. Att'y Gen. No. 69-254.

Funds used to pay housekeepers subject to state requirements.

- Funds collected by the Department of Defense as billeting funds or armory rentals pursuant to regulations issued under O.C.G.A. § 38-2-195 are state funds which may be retained by that department. The management of the funds is subject to requirements of the Office of Planning and Budget, the State Auditor, and the State Depository Board. Housekeeping personnel are state employees. As state employees, housekeeping personnel are entitled to the benefits authorized under the State Merit System and other laws upon compliance with the terms of participation. 1993 Op. Att'y Gen.
