Chapter 44 - Redevelopment Powers
§ 36-44-1. Short Title

Universal Citation: GA Code § 36-44-1 (2020)

This chapter shall be known and may be cited as the "Redevelopment Powers Law."

JUDICIAL DECISIONS

Power to impose fees.

- An intergovernmental agreement between a city and development authority was lawful under Ga. Const. 1983, Art. IX, Sec. II, Para. VII(c), despite the objectors' claim that the city was not authorized to assess infrastructure fees and provide the fees as payment for bonds; the city had statutory authority to impose the fees under the Redevelopment Powers Law, O.C.G.A. § 36-44-1 et seq., and O.C.G.A. § 36-88-6(g)(1) of the Enterprise Zone Employment Act, O.C.G.A. § 36-88-1 et seq. Franzen v. Downtown Dev. Auth. of Atlanta, Ga. , 845 S.E.2d 539 (2020).
