53-9-40. (Pre-1998 Probate Code) "Absentee" defined


As used in this part, the term "absentee" shall mean and include any person who is serving in or with the armed forces of the United States, the Red Cross, the merchant marine, or otherwise, during any period of time when a state of hostilities exists between the United States and any other nation or power and for a period of one year thereafter, which person has been reported or listed as missing in action, as interned in a neutral country, or as having been captured by the enemy.
