CHAPTER 9 - ADMINISTRATION OF ESTATES OF MISSING PERSONS AND PERSONS BELIEVED TO BE DEAD
ARTICLE 1 - ADMINISTRATION OF ESTATES OF PERSONS BELIEVED TO BE DEAD
§ 53-9-6 - (Pre-1998 Probate Code) Revocation of letters upon proof that supposed decedent is alive; effect

O.C.G.A. 53-9-6 (2010)
53-9-6. (Pre-1998 Probate Code) Revocation of letters upon proof that supposed decedent is alive; effect

The judge of the probate court, upon application of the supposed decedent, shall revoke the letters issued under Code Section 53-9-3 at any time, on due and satisfactory proof that the supposed decedent is in fact alive; after which revocation all the powers of the administrator or executor shall cease, but all receipts or disbursements of assets and other acts previously done by the administrator or executor shall remain valid. The administrator or executor shall settle an account of his administration to the time of revocation and shall transfer all assets remaining in his hands to the person as whose administrator or executor he had acted or to his duly authorized agent or attorney; provided, however, that nothing contained in this Code section shall validate the title of any person to any money or property received by a surviving spouse, next of kin, or heir of the supposed decedent; but the same may be recovered from such person unless the property has been transferred for an adequate consideration to a bona fide purchaser, and in such case the supposed decedent may recover from the surviving spouse, next of kin, or heir the amount of money or the property received by him from the bona fide purchaser as consideration for the transfer.
