53-8-48. (Pre-1998 Probate Code) Effect of warranty in conveyance or contract; personal liability of administrator or executor


An administrator or executor may not bind the estate by any warranty in any conveyance or contract made by him. He shall not be personally bound by such covenant unless the intention to create a personal liability is distinctly expressed therein.
