53-8-5. (Pre-1998 Probate Code) Investments in real property; court order; when court may act; service


Executors and administrators are authorized to invest any funds held by them in real property after first obtaining an order to that effect from the judge of the probate court or from the judge of the superior court. The judge shall be authorized to pass upon the application immediately if all the heirs or beneficiaries are sui juris and have acknowledged service and consent thereto or at any time after ten days after service is perfected on the heirs and beneficiaries.
