53-7-93. (Pre-1998 Probate Code) Time of payment of debts of estate; partial payments and successive dividends; procedure when administrator or executor is creditor


The administrator or executor shall pay the debts of the estate, wholly or in part, at the expiration of six months from his appointment. If partial payment shall be made, it shall be pro rata on debts of equal dignity. Successive dividends to creditors shall be made at the end of every year until the estate shall be paid out. If the administrator or executor is a creditor, he may not retain his own debt but shall share with others of equal dignity.
