53-7-102. (Pre-1998 Probate Code) Time of commencement of actions for recovery of decedent's debts; application to administrator de bonis non; substitution of administrator de bonis non in pending actions


No action to recover a debt due by the decedent shall be commenced against the administrator or executor until the expiration of six months from his qualification. This exemption shall not apply to an administrator de bonis non unless he was appointed within the six months allowed to his predecessor. In all cases, the administrator de bonis non shall be made a party to actions pending against the administrator or executor.
