53-7-100. (Pre-1998 Probate Code) Actions to compel making of title according to terms of bond to make title or of contract for sale of land -- Payment of costs


Whenever the party making the bond or contract for the sale of land dies before the time at which the title was to be made and before the purchase money became due, the cost of the proceeding shall be paid by the representative of the estate; but if the time for making the title and the payment of the money elapsed before the death of the obligor, the costs shall be paid by the applicant.
